10	4		AN ACT
11	5		relating to the licensing and regulation of a journeyman lineman.
12	6		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	7		SECTION 1. Section 1305.002(12), Occupations Code, is
14	8		amended to read as follows:
15	9		(12) "Journeyman lineman" means an individual who
16	10		engages in electrical work involving the installation,
17	11		maintenance, and operation of equipment associated with the
18	12		transmission and distribution of electricity from the
19	13		electricity's original source to a substation and from a substation
20	14		to the point where the electricity enters a building or structure on
21	15		a customer's premises for further distribution.
22	16		SECTION 2. Section 1305.101(a), Occupations Code, is
23	17		amended to read as follows:
24	18		(a) The executive director or commission, as appropriate,
25	19		shall:
26	20		(1) by rule establish the financial responsibility
27	21		requirements for electrical contractors; [and]
28	22		(2) after publication of the National Electrical Code
29	23		by the National Fire Protection Association every three years,
30	24		adopt the revised National Electrical Code as the electrical code
31	25		for the state; and
32	26		(3) after the publication of the National Electrical
33	27		Safety Code by the Institute of Electrical and Electronics
34	28		Engineers every five years, adopt the revised National Electrical
35	29		Safety Code for purposes of Section 1305.162(e).
36	30		SECTION 3. Section 1305.162, Occupations Code, is amended
37	31		by adding Subsection (e) to read as follows:
38	32		(e) In addition to the other requirements of this section,
39	33		the department shall accept, develop, or contract for a journeyman
40	34		lineman examination that tests an applicant's knowledge of:
41	35		(1) materials and methods used in the installation,
42	36		maintenance, and operation of equipment associated with the
43	37		transmission and distribution of electricity from the
44	38		electricity's original source to a substation and from a substation
45	39		to the point where the electricity enters a building or structure on
46	40		a customer's premises for further distribution; and
47	41		(2) the standards prescribed by the National
48	42		Electrical Safety Code as adopted by the commission.
49	43		SECTION 4. Section 1305.162(e), Occupations Code, as added
50	44		by this Act, applies only to an examination for a journeyman lineman
51	45		license administered on or after June 1, 2016. An examination for a
52	46		journeyman lineman license administered before that date is
53	47		governed by the law in effect on the date the examination was
54	48		administered, and the former law is continued in effect for that
55	49		purpose.
56	50		SECTION 5. Not later than March 1, 2016, the Texas
57	51		Commission of Licensing and Regulation shall adopt rules necessary
58	52		to implement Sections 1305.101(a)(3) and 1305.162(e), Occupations
59	53		Code, as added by this Act.
60	54		SECTION 6. This Act takes effect September 1, 2015.
