99 relating to a sales and use tax exemption for certain cleaning
1010 services performed for a health care facility.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1313 by adding Section 151.3502 to read as follows:
1414 Sec. 151.3502. CLEANING SERVICES PERFORMED FOR HEALTH CARE
1515 FACILITY. (a) In this section, "health care facility" has the
1616 meaning assigned by Section 108.002, Health and Safety Code.
1717 (b) The following are exempted from the taxes imposed by
1818 this chapter when performed for a health care facility:
1919 (1) cleaning, janitorial, or custodial services
2020 performed inside the health care facility; or
2121 (2) cleaning patient care equipment, tools, or
2222 devices.
2323 SECTION 2. The change in law made by this Act does not
2424 affect tax liability accruing before the effective date of this
2525 Act. That liability continues in effect as if this Act had not been
2626 enacted, and the former law is continued in effect for the
2727 collection of taxes due and for civil and criminal enforcement of
2828 the liability for those taxes.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
