9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 2051.101, Occupations Code, is amended | |
11 | 11 | by amending Subsection (a) and adding Subsection (b-1) to read as | |
12 | 12 | follows: | |
13 | 13 | (a) Except as provided by Subsection (b) or (b-1), an | |
14 | 14 | individual may not act as an athlete agent in this state or | |
15 | 15 | represent that the individual is an athlete agent in this state | |
16 | 16 | unless the individual holds a certificate of registration under | |
17 | 17 | this chapter as: | |
18 | 18 | (1) a professional athlete agent; or | |
19 | 19 | (2) a limited athlete agent. | |
20 | 20 | (b-1) An attorney licensed in this state is not required to | |
21 | 21 | hold a certificate of registration under this chapter to act as an | |
22 | 22 | athlete agent. A licensed attorney who acts as an athlete agent in | |
23 | 23 | this state is considered to be registered under this chapter and | |
24 | 24 | must comply with and is subject to all other provisions of this | |
25 | 25 | chapter. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2015. |
