| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 54.036, Local Government Code, is |
|---|
| 16 | 9 | | amended to read as follows: |
|---|
| 17 | 10 | | Sec. 54.036. FUNCTIONS. A commission panel may: |
|---|
| 18 | 11 | | (1) order the repair, within a fixed period, of |
|---|
| 19 | 12 | | buildings found to be in violation of an ordinance; |
|---|
| 20 | 13 | | (2) declare a building substandard in accordance with |
|---|
| 21 | 14 | | the powers granted by this subchapter; |
|---|
| 22 | 15 | | (3) order, in an appropriate case, the immediate |
|---|
| 23 | 16 | | removal of persons or property found on private property, enter on |
|---|
| 24 | 17 | | private property to secure the removal if it is determined that |
|---|
| 25 | 18 | | conditions exist on the property that constitute a violation of an |
|---|
| 26 | 19 | | ordinance, and order action to be taken as necessary to remedy, |
|---|
| 27 | 20 | | alleviate, or remove any substandard building found to exist; |
|---|
| 28 | 21 | | (4) issue orders or directives to any peace officer of |
|---|
| 29 | 22 | | the state, including a sheriff or constable or the chief of police |
|---|
| 30 | 23 | | of the municipality, to enforce and carry out the lawful orders or |
|---|
| 31 | 24 | | directives of the commission panel; |
|---|
| 32 | 25 | | (5) determine the amount and duration of the civil |
|---|
| 33 | 26 | | penalty the municipality may recover as provided by Section 54.017; |
|---|
| 34 | 27 | | or |
|---|
| 35 | 28 | | (6) order action to be taken as necessary to remedy, |
|---|
| 36 | 29 | | alleviate, or abate a violation of an ordinance relating to: |
|---|
| 37 | 30 | | (A) animal care and control; or |
|---|
| 38 | 31 | | (B) a water conservation measure, including a |
|---|
| 39 | 32 | | water restriction. |
|---|
| 40 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 41 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 37 | | Act takes effect September 1, 2015. |
