11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 623, Transportation Code, |
---|
13 | 13 | | is amended by adding Section 623.0172 to read as follows: |
---|
14 | 14 | | Sec. 623.0172. OCEAN CARGO SHIPPING CONTAINERS. (a) In |
---|
15 | 15 | | this section, "ocean cargo shipping container" means an enclosed, |
---|
16 | 16 | | standardized, reusable container that: |
---|
17 | 17 | | (1) is used to pack, ship, move, or transport cargo; |
---|
18 | 18 | | (2) is designed to be carried on a trailer or |
---|
19 | 19 | | semitrailer and loaded onto a vessel for ocean-borne |
---|
20 | 20 | | transportation; and |
---|
21 | 21 | | (3) when combined with vehicles transporting the |
---|
22 | 22 | | container, has a gross weight that exceeds the limits allowed by law |
---|
23 | 23 | | to be transported over a state highway. |
---|
24 | 24 | | (b) The department may issue an annual permit for the |
---|
25 | 25 | | movement of a sealed ocean cargo shipping container moving in |
---|
26 | 26 | | overseas international commerce on a trailer or semitrailer with |
---|
27 | 27 | | three axles if the combination of vehicles transporting the |
---|
28 | 28 | | container has: |
---|
29 | 29 | | (1) a single axle weight of not more than 20,000 |
---|
30 | 30 | | pounds; |
---|
31 | 31 | | (2) a tandem axle weight of not more than 40,000 |
---|
32 | 32 | | pounds; |
---|
33 | 33 | | (3) a tri-axle weight of not more than 60,000 pounds; |
---|
34 | 34 | | and |
---|
35 | 35 | | (4) a gross weight of not more than 97,000 pounds. |
---|
36 | 36 | | (c) The department shall restrict vehicles operating under |
---|
37 | 37 | | a permit under this section to routes that: |
---|
38 | 38 | | (1) do not include: |
---|
39 | 39 | | (A) roadways or bridges that the department |
---|
40 | 40 | | determines through sound engineering principles should not be used |
---|
41 | 41 | | for overweight vehicles; or |
---|
42 | 42 | | (B) federal highways, if the department |
---|
43 | 43 | | determines that the operation of a vehicle under a permit under this |
---|
44 | 44 | | section on those highways would result in the loss of federal |
---|
45 | 45 | | highway funding; and |
---|
46 | 46 | | (2) end at a facility in this state at which the sealed |
---|
47 | 47 | | container will be loaded on a ship or train in the course of |
---|
48 | 48 | | overseas international shipment. |
---|
49 | 49 | | (d) The department may adopt rules necessary to implement |
---|
50 | 50 | | this section, including rules: |
---|
51 | 51 | | (1) governing application for a permit under this |
---|
52 | 52 | | section; and |
---|
53 | 53 | | (2) requiring additional safety and driver training. |
---|
54 | 54 | | (e) The department shall set the amount of the fee for an |
---|
55 | 55 | | annual permit issued under this section in an amount not to exceed |
---|
56 | 56 | | $7,000, of which: |
---|
57 | 57 | | (1) 90 percent shall be deposited to the credit of the |
---|
58 | 58 | | state highway fund; and |
---|
59 | 59 | | (2) 10 percent shall be deposited to the credit of the |
---|
60 | 60 | | Texas Department of Motor Vehicles fund. |
---|
61 | 61 | | SECTION 2. This Act takes effect January 1, 2016. |
