99 relating to the movement of vehicles transporting ocean cargo
1010 shipping containers; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 623, Transportation Code,
1313 is amended by adding Section 623.0172 to read as follows:
1414 Sec. 623.0172. OCEAN CARGO SHIPPING CONTAINERS. (a) In
1515 this section, "ocean cargo shipping container" means an enclosed,
1616 standardized, reusable container that:
1717 (1) is used to pack, ship, move, or transport cargo;
1818 (2) is designed to be carried on a trailer or
1919 semitrailer and loaded onto a vessel for ocean-borne
2020 transportation; and
2121 (3) when combined with vehicles transporting the
2222 container, has a gross weight that exceeds the limits allowed by law
2323 to be transported over a state highway.
2424 (b) The department may issue an annual permit for the
2525 movement of a sealed ocean cargo shipping container moving in
2626 overseas international commerce on a trailer or semitrailer with
2727 three axles if the combination of vehicles transporting the
2828 container has:
2929 (1) a single axle weight of not more than 20,000
3030 pounds;
3131 (2) a tandem axle weight of not more than 40,000
3232 pounds;
3333 (3) a tri-axle weight of not more than 60,000 pounds;
3434 and
3535 (4) a gross weight of not more than 97,000 pounds.
3636 (c) The department shall restrict vehicles operating under
3737 a permit under this section to routes that:
3838 (1) do not include:
3939 (A) roadways or bridges that the department
4040 determines through sound engineering principles should not be used
4141 for overweight vehicles; or
4242 (B) federal highways, if the department
4343 determines that the operation of a vehicle under a permit under this
4444 section on those highways would result in the loss of federal
4545 highway funding; and
4646 (2) end at a facility in this state at which the sealed
4747 container will be loaded on a ship or train in the course of
4848 overseas international shipment.
4949 (d) The department may adopt rules necessary to implement
5050 this section, including rules:
5151 (1) governing application for a permit under this
5252 section; and
5353 (2) requiring additional safety and driver training.
5454 (e) The department shall set the amount of the fee for an
5555 annual permit issued under this section in an amount not to exceed
5656 $7,000, of which:
5757 (1) 90 percent shall be deposited to the credit of the
5858 state highway fund; and
5959 (2) 10 percent shall be deposited to the credit of the
6060 Texas Department of Motor Vehicles fund.
6161 SECTION 2. This Act takes effect January 1, 2016.
