99 relating to the regulation of the sale of dextromethorphan to
1010 minors; providing civil penalties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 6, Health and Safety Code, is
1313 amended by adding Chapter 487 to read as follows:
1414 CHAPTER 487. OVER-THE-COUNTER SALES OF DEXTROMETHORPHAN
1515 Sec. 487.001. DEFINITIONS. (a) In this chapter:
1616 (1) "Dextromethorphan" means any compound, mixture,
1717 or preparation containing any detectable amount of that substance,
1818 including its salts, optical isomers, and salts of optical isomers.
1919 (2) "Sale" includes a conveyance, exchange, barter, or
2020 trade.
2121 (b) A term that is used in this chapter but is not defined by
2222 Subsection (a) has the meaning assigned by Section 481.002 if the
2323 term is defined in that section.
2424 Sec. 487.002. NONAPPLICABILITY. (a) This chapter does not
2525 apply to the sale of any product dispensed or delivered by a
2626 pharmacist according to a prescription issued by a practitioner for
2727 a valid medical purpose and in the course of professional practice.
2828 (b) This chapter does not require a business establishment
2929 to:
3030 (1) keep specific records of transactions covered by
3131 this chapter; or
3232 (2) store dextromethorphan in a specific location in a
3333 business establishment or otherwise restrict the availability of
3434 dextromethorphan to customers.
3535 Sec. 487.003. DISTRIBUTION TO MINORS PROHIBITED;
3636 PREREQUISITE TO SALE. (a) A business establishment shall not
3737 dispense, distribute, or sell dextromethorphan to a customer under
3838 18 years of age.
3939 (b) Before dispensing, distributing, or selling
4040 dextromethorphan over the counter, a business establishment must
4141 require the customer obtaining the drug to display a driver's
4242 license or other form of identification containing the customer's
4343 photograph and indicating that the customer is 18 years of age or
4444 older, unless from the customer's outward appearance the person
4545 making the sale may reasonably presume the customer to be 27 years
4646 of age or older.
4747 Sec. 487.004. VIOLATION; CIVIL PENALTY. (a) A county or
4848 district attorney shall issue a warning to a business establishment
4949 for a first violation of this chapter.
5050 (b) After receiving a warning for the first violation under
5151 Subsection (a), a business establishment is liable to the state for
5252 a civil penalty of:
5353 (1) $150 for the second violation; and
5454 (2) $250 for each subsequent violation.
5555 (c) It is a defense in an action brought under this section
5656 that the person to whom the dextromethorphan was dispensed,
5757 distributed, or sold presented to the business establishment
5858 apparently valid proof of identification.
5959 (d) A proof of identification satisfies the requirements of
6060 Subsection (c) if it contains a physical description and photograph
6161 consistent with the person's appearance, purports to establish that
6262 the person is 18 years of age or older, and was issued by a
6363 governmental agency. The proof of identification may include a
6464 driver's license issued by this state or another state, a passport,
6565 or an identification card issued by a state or the federal
6666 government.
6767 SECTION 2. The change in law made by this Act applies only
6868 to a transaction at a business establishment that occurs on or after
6969 the effective date of this Act.
7070 SECTION 3. This Act takes effect September 1, 2015.
