55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to responsibility of new owners of residential rental
88 property for tenant security deposits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 92.105, Property Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (b-1) to
1212 read as follows:
1313 (a) If the owner's interest in the premises is terminated by
1414 sale, assignment, death, appointment of a receiver, bankruptcy, or
1515 otherwise, the new owner is liable for the return of security
1616 deposits according to this subchapter from the date title to the
1717 premises is acquired [, regardless of whether notice is given to the
1818 tenant under Subsection (b) of this section].
1919 (b) The [person who no longer owns an interest in the rental
2020 premises remains liable for a security deposit received while the
2121 person was the owner until the] new owner shall deliver [delivers]
2222 to the tenant a signed statement acknowledging that the new owner
2323 has acquired the property [received] and is responsible for the
2424 tenant's security deposit and specifying the exact dollar amount of
2525 the deposit.
2626 (b-1) The person who no longer owns an interest in the
2727 rental premises is liable to the new owner for a security deposit
2828 received while the person was the owner until the new owner has
2929 received the deposit.
3030 SECTION 2. The changes in law made by this Act apply only to
3131 a security deposit received on or after the effective date of this
3232 Act. A security deposit received before the effective date of this
3333 Act is governed by the law applicable to the security deposit
3434 immediately before that date, and the former law is continued in
3535 effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2015.
