55 AN ACT
66 relating to the improvement of efficiencies in benefit applications
77 submitted to the Health and Human Services Commission.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1010 amended by adding Sections 531.03171 and 531.03172 to read as
1111 follows:
1212 Sec. 531.03171. REQUIREMENTS FOR THIRD-PARTY ENTITIES
1313 ELECTRONICALLY SUBMITTING BENEFIT APPLICATIONS TO THE COMMISSION.
1414 (a) A third-party entity that electronically submits benefit
1515 applications on behalf of clients for assistance programs
1616 administered by the commission shall:
1717 (1) provide or facilitate the provision of information
1818 or assistance to clients at a physical location in the state;
1919 (2) assist clients with the establishment of an online
2020 account for benefit assistance programs on the client benefits
2121 website administered by the commission; and
2222 (3) provide clients the opportunity to submit a full
2323 and complete benefit application in the format prescribed by the
2424 commission, to the maximum extent possible.
2525 (b) A third-party entity may partner or contract with
2626 another entity for assistance submitting benefit applications to
2727 the commission to the extent the third-party entity meets the
2828 requirements of Subsection (a).
2929 (c) A third-party entity shall use a data collection
3030 application system that matches the information requirements of the
3131 benefit applications prescribed by the commission.
3232 (d) A third-party entity may not be a for-profit entity.
3333 (e) A third-party entity does not include:
3434 (1) an authorized representative as defined by the
3535 commission or federal law for the respective assistance program;
3636 (2) a person, community-based organization, or
3737 faith-based organization participating in the Community-Based
3838 Navigator Program under Subchapter S; or
3939 (3) an organization participating in the Electronic
4040 Eligibility Information Pilot Project under Section 531.02415.
4141 Sec. 531.03172. COMMISSION STANDARDS FOR THIRD-PARTY
4242 ENTITIES SUBMITTING BENEFIT APPLICATIONS. (a) The commission
4343 shall establish minimum standards and technical requirements by
4444 contract, memorandum of understanding, or other agreement with
4545 third-party entities electronically submitting benefit
4646 applications on behalf of clients for programs administered by the
4747 commission. The standards may include requirements for payment to
4848 the commission for the costs of implementing technology changes
4949 required by the contract, memorandum of understanding, or other
5050 agreement.
5151 SECTION 2. The Health and Human Services Commission will
5252 implement the amendments made by this Act to the extent
5353 implementation is consistent with federal law.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2015.
