124 relating to the creation of the Brazoria County Municipal Utility
135 District No. 68; granting a limited power of eminent domain;
146 providing authority to issue bonds; providing authority to impose
157 assessments, fees, or taxes.
168 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
179 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1810 Code, is amended by adding Chapter 8493 to read as follows:
1911 CHAPTER 8493. BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 68
2012 SUBCHAPTER A. GENERAL PROVISIONS
2113 Sec. 8493.001. DEFINITIONS. In this chapter:
2214 (1) "Board" means the district's board of directors.
2315 (2) "Commission" means the Texas Commission on
2416 Environmental Quality.
2517 (3) "Director" means a board member.
2618 (4) "District" means the Brazoria County Municipal
2719 Utility District No. 68.
2820 Sec. 8493.002. NATURE OF DISTRICT. The district is a
2921 municipal utility district created under Section 59, Article XVI,
3022 Texas Constitution.
3123 Sec. 8493.003. CONFIRMATION AND DIRECTORS' ELECTION
3224 REQUIRED. The temporary directors shall hold an election to
3325 confirm the creation of the district and to elect five permanent
3426 directors as provided by Section 49.102, Water Code.
3527 Sec. 8493.004. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3628 The district is created to serve a public purpose and benefit.
3729 (b) The district is created to accomplish the purposes of:
3830 (1) a municipal utility district as provided by
3931 general law and Section 59, Article XVI, Texas Constitution; and
4032 (2) Section 52, Article III, Texas Constitution, that
4133 relate to the construction, acquisition, improvement, operation,
4234 or maintenance of macadamized, graveled, or paved roads, or
4335 improvements, including storm drainage, in aid of those roads.
4436 Sec. 8493.005. INITIAL DISTRICT TERRITORY. (a) The
4537 district is initially composed of the territory described by
4638 Section 2 of the Act enacting this chapter.
4739 (b) The boundaries and field notes contained in Section 2 of
4840 the Act enacting this chapter form a closure. A mistake made in the
4941 field notes or in copying the field notes in the legislative process
5042 does not affect the district's:
5143 (1) organization, existence, or validity;
5244 (2) right to issue any type of bond for the purposes
5345 for which the district is created or to pay the principal of and
5446 interest on a bond;
5547 (3) right to impose a tax; or
5648 (4) legality or operation.
5749 Sec. 8493.006. CONSENT OF MUNICIPALITY. Municipal consent
5850 to the creation of the district acts as municipal consent to the
5951 creation of any new district created by the division of the district
6052 under Section 8493.107.
6153 SUBCHAPTER B. BOARD OF DIRECTORS
6254 Sec. 8493.051. GOVERNING BODY; TERMS. (a) The district is
6355 governed by a board of five elected directors.
6456 (b) Except as provided by Section 8493.052, directors serve
6557 staggered four-year terms.
6658 Sec. 8493.052. TEMPORARY DIRECTORS. (a) On or after the
6759 effective date of the Act enacting this chapter, the owner or owners
6860 of a majority of the assessed value of the real property in the
6961 district may submit a petition to the commission requesting that
7062 the commission appoint as temporary directors the five persons
7163 named in the petition. The commission shall appoint as temporary
7264 directors the five persons named in the petition.
7365 (b) Temporary directors serve until the earlier of:
7466 (1) the date permanent directors are elected under
7567 Section 8493.003; or
7668 (2) the fourth anniversary of the effective date of
7769 the Act enacting this chapter.
7870 (c) If permanent directors have not been elected under
7971 Section 8493.003 and the terms of the temporary directors have
8072 expired, successor temporary directors shall be appointed or
8173 reappointed as provided by Subsection (d) to serve terms that
8274 expire on the earlier of:
8375 (1) the date permanent directors are elected under
8476 Section 8493.003; or
8577 (2) the fourth anniversary of the date of the
8678 appointment or reappointment.
8779 (d) If Subsection (c) applies, the owner or owners of a
8880 majority of the assessed value of the real property in the district
8981 may submit a petition to the commission requesting that the
9082 commission appoint as successor temporary directors the five
9183 persons named in the petition. The commission shall appoint as
9284 successor temporary directors the five persons named in the
9385 petition.
9486 SUBCHAPTER C. POWERS AND DUTIES
9587 Sec. 8493.101. GENERAL POWERS AND DUTIES. The district has
9688 the powers and duties necessary to accomplish the purposes for
9789 which the district is created.
9890 Sec. 8493.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9991 DUTIES. The district has the powers and duties provided by the
10092 general law of this state, including Chapters 49 and 54, Water Code,
10193 applicable to municipal utility districts created under Section 59,
10294 Article XVI, Texas Constitution.
10395 Sec. 8493.103. LEVEE IMPROVEMENT DISTRICT POWERS AND
10496 DUTIES. The district has the powers and duties provided by the
10597 general law of this state, including Chapter 57, Water Code,
10698 applicable to levee improvement districts created under Section 59,
10799 Article XVI, Texas Constitution.
108100 Sec. 8493.104. AUTHORITY FOR ROAD PROJECTS. Under Section
109101 52, Article III, Texas Constitution, the district may design,
110102 acquire, construct, finance, issue bonds for, improve, operate,
111103 maintain, and convey to this state, a county, or a municipality for
112104 operation and maintenance macadamized, graveled, or paved roads, or
113105 improvements, including storm drainage, in aid of those roads.
114106 Sec. 8493.105. ROAD STANDARDS AND REQUIREMENTS. (a) A road
115107 project must meet all applicable construction standards, zoning and
116108 subdivision requirements, and regulations of each municipality in
117109 whose corporate limits or extraterritorial jurisdiction the road
118110 project is located.
119111 (b) If a road project is not located in the corporate limits
120112 or extraterritorial jurisdiction of a municipality, the road
121113 project must meet all applicable construction standards,
122114 subdivision requirements, and regulations of each county in which
123115 the road project is located.
124116 (c) If the state will maintain and operate the road, the
125117 Texas Transportation Commission must approve the plans and
126118 specifications of the road project.
127119 Sec. 8493.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
128120 OR RESOLUTION. The district shall comply with all applicable
129121 requirements of any ordinance or resolution that is adopted under
130122 Section 54.016 or 54.0165, Water Code, and that consents to the
131123 creation of the district or to the inclusion of land in the
132124 district.
133125 Sec. 8493.107. DIVISION OF DISTRICT. (a) The district may
134126 be divided into two or more new districts only if:
135127 (1) the district has no outstanding bonded debt; and
136128 (2) the district is not imposing ad valorem taxes.
137129 (b) This chapter applies to any new district created by the
138130 division of the district, and a new district has all the powers and
139131 duties of the district.
140132 (c) Any new district created by the division of the district
141133 may not, at the time the new district is created, contain any land
142134 outside the area described by Section 2 of the Act creating this
143135 chapter.
144136 (d) The board, on its own motion or on receipt of a petition
145137 signed by the owner or owners of a majority of the assessed value of
146138 the real property in the district, may adopt an order dividing the
147139 district.
148140 (e) The board may adopt an order dividing the district
149141 before or after the date the board holds an election under Section
150142 8493.003 to confirm the creation of the district.
151143 (f) An order dividing the district shall:
152144 (1) name each new district;
153145 (2) include the metes and bounds description of the
154146 territory of each new district;
155147 (3) appoint temporary directors for each new district;
156148 and
157149 (4) provide for the division of assets and liabilities
158150 between or among the new districts.
159151 (g) On or before the 30th day after the date of adoption of
160152 an order dividing the district, the district shall file the order
161153 with the commission and record the order in the real property
162154 records of each county in which the district is located.
163155 (h) Any new district created by the division of the district
164156 shall hold a confirmation and directors' election as required by
165157 Section 8493.003.
166158 (i) If the creation of the new district is confirmed, the
167159 new district shall provide the election date and results to the
168160 commission.
169161 (j) Any new district created by the division of the district
170162 must hold an election as required by this chapter to obtain voter
171163 approval before the district may impose a maintenance tax or issue
172164 bonds payable wholly or partly from ad valorem taxes.
173165 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
174166 Sec. 8493.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
175167 district may issue, without an election, bonds and other
176168 obligations secured by:
177169 (1) revenue other than ad valorem taxes; or
178170 (2) contract payments described by Section 8493.153.
179171 (b) The district must hold an election in the manner
180172 provided by Chapters 49 and 54, Water Code, to obtain voter approval
181173 before the district may impose an ad valorem tax or issue bonds
182174 payable from ad valorem taxes.
183175 (c) The district may not issue bonds payable from ad valorem
184176 taxes to finance a road project unless the issuance is approved by a
185177 vote of a two-thirds majority of the district voters voting at an
186178 election held for that purpose.
187179 Sec. 8493.152. OPERATION AND MAINTENANCE TAX. (a) If
188180 authorized at an election held under Section 8493.151, the district
189181 may impose an operation and maintenance tax on taxable property in
190182 the district in accordance with Section 49.107, Water Code.
191183 (b) The board shall determine the tax rate. The rate may not
192184 exceed the rate approved at the election.
193185 Sec. 8493.153. CONTRACT TAXES. (a) In accordance with
194186 Section 49.108, Water Code, the district may impose a tax other than
195187 an operation and maintenance tax and use the revenue derived from
196188 the tax to make payments under a contract after the provisions of
197189 the contract have been approved by a majority of the district voters
198190 voting at an election held for that purpose.
199191 (b) A contract approved by the district voters may contain a
200192 provision stating that the contract may be modified or amended by
201193 the board without further voter approval.
202194 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
203195 Sec. 8493.201. AUTHORITY TO ISSUE BONDS AND OTHER
204196 OBLIGATIONS. The district may issue bonds or other obligations
205197 payable wholly or partly from ad valorem taxes, impact fees,
206198 revenue, contract payments, grants, or other district money, or any
207199 combination of those sources, to pay for any authorized district
208200 purpose.
209201 Sec. 8493.202. TAXES FOR BONDS. At the time the district
210202 issues bonds payable wholly or partly from ad valorem taxes, the
211203 board shall provide for the annual imposition of a continuing
212204 direct ad valorem tax, without limit as to rate or amount, while all
213205 or part of the bonds are outstanding as required and in the manner
214206 provided by Sections 54.601 and 54.602, Water Code.
215207 Sec. 8493.203. BONDS FOR ROAD PROJECTS. At the time of
216208 issuance, the total principal amount of bonds or other obligations
217209 issued or incurred to finance road projects and payable from ad
218210 valorem taxes may not exceed one-fourth of the assessed value of the
219211 real property in the district.
220212 SECTION 2. The Brazoria County Municipal Utility District
221213 No. 68 initially includes all the territory contained in the
222214 following area:
223215 5,440.64 acres of land, more or less, being part of the Sam T.
224216 Angier Survey, Abstract 7, part of the L.P. Ehrmann Survey No. 24,
225217 Abstract 521, all of the H.T. & B.R.R. Co. Survey No. 23, Abstract
226218 248, all of the L.P. Ehrmann Survey No. 22, Abstract 519, all of the
227219 H.T. & B.R.R. Co. Survey No. 25, Abstract 277, part of the L.P.
228220 Ehrmann Survey No. 18, Abstract 520, part of the Day Land and Cattle
229221 Company Survey, Abstract 602, part of the Hooper and Wade Survey
230222 No. 11, Abstract 433, part of the H.T. & B.R.R. Co. Survey No. 21,
231223 Abstract 247, part of the L.P. Ehrmann Survey No. 26, Abstract 522,
232224 part of the L.P. Ehrmann Survey No. 28, Abstract 523, all of the
233225 L.P. Ehrmann Survey No. 30, Abstract 524 and part of the James L.

425417 SECTION 3. (a) The legal notice of the intention to
426418 introduce this Act, setting forth the general substance of this
427419 Act, has been published as provided by law, and the notice and a
428420 copy of this Act have been furnished to all persons, agencies,
429421 officials, or entities to which they are required to be furnished

432424 (b) The governor, one of the required recipients, has
433425 submitted the notice and Act to the Texas Commission on
434426 Environmental Quality.
435427 (c) The Texas Commission on Environmental Quality has filed
436428 its recommendations relating to this Act with the governor, the
437429 lieutenant governor, and the speaker of the house of
438430 representatives within the required time.
439431 (d) All requirements of the constitution and laws of this
440432 state and the rules and procedures of the legislature with respect
441433 to the notice, introduction, and passage of this Act are fulfilled
442434 and accomplished.
443435 SECTION 4. (a) If this Act does not receive a two-thirds
444436 vote of all the members elected to each house, Subchapter C, Chapter
445437 8493, Special District Local Laws Code, as added by Section 1 of
446438 this Act, is amended by adding Section 8493.108 to read as follows:
447439 Sec. 8493.108. NO EMINENT DOMAIN POWER. The district may
448440 not exercise the power of eminent domain.
449441 (b) This section is not intended to be an expression of a
450442 legislative interpretation of the requirements of Section 17(c),
451443 Article I, Texas Constitution.
452444 SECTION 5. This Act takes effect immediately if it receives
453445 a vote of two-thirds of all the members elected to each house, as
454446 provided by Section 39, Article III, Texas Constitution. If this
455447 Act does not receive the vote necessary for immediate effect, this
456448 Act takes effect September 1, 2015.
