7 | 7 | | relating to a study on the feasibility and potential costs and |

8 | 8 | | benefits of implementing a pay-for-performance contract program |
---|
9 | 9 | | for certain juvenile justice programs and services. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. (a) In this section, "department" means the |
---|
12 | 12 | | Texas Juvenile Justice Department. |
---|
13 | 13 | | (b) The department shall conduct a study to determine the |
---|
14 | 14 | | feasibility and potential costs and benefits to this state of |
---|
15 | 15 | | implementing a pay-for-performance contract program under which |
---|
16 | 16 | | the department would: |
---|
17 | 17 | | (1) contract with an administrator for the operation |
---|
18 | 18 | | of juvenile justice programs or the provision of juvenile justice |
---|
19 | 19 | | services, the operation or provision of which would be funded using |
---|
20 | 20 | | investor-provided financial capital; and |
---|
21 | 21 | | (2) make contract payments to the administrator using |
---|
22 | 22 | | general obligation bond proceeds or other available money only if |
---|
23 | 23 | | specified performance requirements for and outcomes from the |
---|
24 | 24 | | programs and services are achieved and the return on investment to |
---|
25 | 25 | | this state is positive, thereby rewarding successful results and |
---|
26 | 26 | | shifting the financial risk from this state. |
---|
27 | 27 | | (c) The department may request assistance and information |
---|
28 | 28 | | from the comptroller of public accounts, the Texas Public Finance |
---|
29 | 29 | | Authority, or any other state agency as necessary to conduct the |
---|
30 | 30 | | study required by this section. |
---|
31 | 31 | | (d) Not later than November 1, 2016, the department shall |
---|
32 | 32 | | submit a report on the results of the study to the governor, the |
---|
33 | 33 | | lieutenant governor, and the presiding officers of the standing |
---|
34 | 34 | | committees of the senate and house of representatives having |
---|
35 | 35 | | jurisdiction over juvenile justice programs and services. The |
---|
36 | 36 | | report must indicate whether and to what degree implementing a |
---|
37 | 37 | | pay-for-performance program described by Subsection (b) of this |
---|
38 | 38 | | section would be cost-effective and feasible, as determined by the |
---|
39 | 39 | | department. If the department determines a pay-for-performance |
---|
40 | 40 | | program would be cost-effective and feasible, the report must: |
---|
41 | 41 | | (1) make recommendations regarding the manner in which |
---|
42 | 42 | | the department could effectively operate the program and the types |
---|
43 | 43 | | of juvenile justice programs and services that would be selected |
---|
44 | 44 | | for the program; and |
---|
45 | 45 | | (2) identify any changes in law necessary for |
---|
46 | 46 | | implementation of the program. |
---|
47 | 47 | | (e) This section expires January 1, 2017. |
---|
48 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
---|
49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
52 | 52 | | Act takes effect September 1, 2015. |
