87 AN ACT
98 relating to the establishment of a multi-stakeholder advisory
109 committee on health literacy.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Chapter 1002, Health and Safety Code, is amended
1312 by adding Subchapter F to read as follows:
1413 SUBCHAPTER F. MULTI-STAKEHOLDER ADVISORY COMMITTEE ON HEALTH
1514 LITERACY
1615 Sec. 1002.251. DEFINITIONS. In this subchapter:
1716 (1) "Advisory committee" means the multi-stakeholder
1817 advisory committee on health literacy established under this
1918 subchapter.
2019 (2) "Health literacy" means the degree to which an
2120 individual has the capacity to obtain, communicate, process, and
2221 understand basic health information and services so the person may
2322 make appropriate decisions about the treatment, payment, or
2423 coverage of health care and navigate complexities in the health
2524 care system.
2625 Sec. 1002.252. MULTI-STAKEHOLDER ADVISORY COMMITTEE ON
2726 HEALTH LITERACY. The institute shall establish a multi-stakeholder
2827 advisory committee on health literacy to study and make
2928 recommendations to improve health literacy in this state.
3029 Sec. 1002.253. COMPOSITION OF ADVISORY COMMITTEE. The
3130 advisory committee is composed of:
3231 (1) three members of the board selected by the
3332 presiding officer of the board;
3433 (2) a representative from each of the following
3534 agencies, selected by the executive head of the agency:
3635 (A) the Department of Aging and Disability
3736 Services;
3837 (B) the center for elimination of
3938 disproportionality and disparities;
4039 (C) the Employees Retirement System of Texas;
4140 (D) the Teacher Retirement System of Texas; and
4241 (E) each state agency or system of higher
4342 education that purchases or provides health care services, as
4443 determined by the governor;
4544 (3) the following representatives appointed by the
4645 governor:
4746 (A) three employers domiciled in this state; and
4847 (B) three health care consumers; and
4948 (4) the following ex officio members:
5049 (A) the commissioner or the commissioner's
5150 designee;
5251 (B) the commissioner of insurance or the
5352 commissioner of insurance's designee; and
5453 (C) the state Medicaid director of the commission
5554 or the director's designee.
5655 Sec. 1002.254. PRESIDING OFFICER. The board shall appoint
5756 from among the members of the advisory committee a presiding
5857 officer and an assistant presiding officer.
5958 Sec. 1002.255. VACANCY. A vacancy on the advisory
6059 committee shall be filled by appointment in the same manner as the
6160 original appointment.
6261 Sec. 1002.256. MEETINGS. The advisory committee shall meet
6362 at the call of the presiding officer.
6463 Sec. 1002.257. DUTIES. (a) The advisory committee shall:
6564 (1) develop an expanded definition of health literacy
6665 that includes a focus on a patient's need for transparent
6766 information about the cost and quality of health care and available
6867 treatment options;
6968 (2) examine the impact of low health literacy on
7069 health care cost and quality outcomes; and
7170 (3) develop policy recommendations, based on the
7271 findings of the advisory committee, to:
7372 (A) promote the use of plain language by health
7473 care providers;
7574 (B) promote the use of simplified enrollment
7675 forms;
7776 (C) develop health literacy resources for both
7877 providers and consumers of health care; and
7978 (D) develop programs to support improved health
8079 literacy.
8180 (b) The advisory committee may consult with and invite
8281 participation from groups, organizations, and agencies as needed to
8382 accomplish the goals of the committee.
8483 Sec. 1002.258. ADMINISTRATIVE SUPPORT. The institute shall
8584 provide administrative support for the advisory committee.
8685 Sec. 1002.259. REPORT. (a) The advisory committee shall
8786 prepare a report that includes the committee's findings and policy
8887 recommendations under Section 1002.257.
8988 (b) Not later than October 1, 2016, the advisory committee
9089 shall submit the report required under this section to the
9190 institute for inclusion in the institute's biennial report and
9291 recommendations to the legislature.
9392 Sec. 1002.260. COMPENSATION; REIMBURSEMENT. Members of the
9493 advisory committee serve without compensation and may not be
9594 reimbursed for travel or other expenses incurred while conducting
9695 the business of the advisory committee.
9796 Sec. 1002.261. EXPIRATION. The advisory committee is
9897 abolished and this subchapter expires September 1, 2017.
9998 SECTION 2. Not later than December 1, 2015, the appropriate
10099 appointing authorities shall appoint the members of the
101100 multi-stakeholder advisory committee on health literacy in
102101 accordance with Subchapter F, Chapter 1002, Health and Safety Code,
103102 as added by this Act.
104103 SECTION 3. This Act takes effect September 1, 2015.
