44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the requirements for request for proposals for
77 design-build contracts for highway projects and the scope of and
88 limitation on design-build contracts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 223.246(a) and (b), Transportation
1111 Code, are amended to read as follows:
1212 (a) The department shall issue a request for proposals to
1313 proposers short-listed under Section 223.245. A request for
1414 proposals must include:
1515 (1) information on the overall project goals;
1616 (2) publicly available cost estimates for the
1717 design-build portion of the project;
1818 (3) materials specifications;
1919 (4) special material requirements;
2020 (5) [a schematic design approximately 30 percent
2121 complete;
2222 [(6)] known utilities, provided that the department is
2323 not required to undertake an effort to locate utilities;
2424 (6) [(7)] quality assurance and quality control
2525 requirements;
2626 (7) [(8)] the location of relevant structures;
2727 (8) [(9)] notice of any rules or goals adopted by the
2828 department relating to awarding contracts to disadvantaged
2929 business enterprises or small business enterprises;
3030 (9) [(10)] available geotechnical or other
3131 information related to the project;
3232 (10) [(11)] the status of any environmental review of
3333 the project;
3434 (11) [(12)] detailed instructions for preparing the
3535 technical proposal required under Subsection (d), including a
3636 description of the form and level of completeness of drawings
3737 expected;
3838 (12) [(13)] the relative weighting of the technical
3939 and cost proposals required under Subsection (d) and the formula by
4040 which the proposals will be evaluated and ranked; and
4141 (13) [(14)] the criteria to be used in evaluating the
4242 technical proposals, and the relative weighting of those criteria.
4343 (b) The formula used to evaluate proposals under Subsection
4444 (a)(12) [(a)(13)] must allocate at least 70 percent of the
4545 weighting to the cost proposal.
4646 SECTION 2. Section 370.401(d), Transportation Code, is
4747 repealed.
4848 SECTION 3. Section 370.406(a), Transportation Code, is
4949 amended to read as follows:
5050 (a) An authority shall issue a request for detailed
5151 proposals to proposers qualified or short-listed under Section
5252 370.405. A request for detailed proposals must include:
5353 (1) information on the overall project goals;
5454 (2) the authority's cost estimates for the
5555 design-build portion of the work;
5656 (3) materials specifications;
5757 (4) special material requirements;
5858 (5) [a schematic design approximately 30 percent
5959 complete;
6060 [(6)] known utilities, provided that an authority is
6161 not required to undertake an effort to locate utilities;
6262 (6) [(7)] quality assurance and quality control
6363 requirements;
6464 (7) [(8)] the location of relevant structures;
6565 (8) [(9)] notice of any rules or goals adopted by the
6666 authority pursuant to Section 370.183 relating to awarding
6767 contracts to disadvantaged businesses;
6868 (9) [(10)] available geotechnical or other
6969 information related to the project;
7070 (10) [(11)] the status of any environmental review of
7171 the project;
7272 (11) [(12)] detailed instructions for preparing the
7373 technical proposal required under Subsection (c), including a
7474 description of the form and level of completeness of drawings
7575 expected;
7676 (12) [(13)] the relative weighting of the technical
7777 and cost proposals required under Subsection (c) and the formula by
7878 which the proposals will be evaluated and ranked, provided that the
7979 formula shall allocate at least 70 percent of the weighting to the
8080 cost proposal; and
8181 (13) [(14)] the criteria and weighting for each
8282 element of the technical proposal.
8383 SECTION 4. The change in law made by this Act applies only
8484 to a contract entered into on or after the effective date of this
8585 Act. A contract entered into before the effective date of this Act
8686 is governed by the law in effect when the contract was entered into,
8787 and the former law is continued in effect for that purpose.
8888 SECTION 5. This Act takes effect August 31, 2015.
