| 7 | 7 | | security functions of certain state agencies. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 322, Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 322.025 to read as follows: |
|---|
| 11 | 11 | | Sec. 322.025. REPORT ON BORDER SECURITY FUNCTIONS. (a) In |
|---|
| 12 | 12 | | this section: |
|---|
| 13 | 13 | | (1) "Border county" means a county that is adjacent to |
|---|
| 14 | 14 | | or within 25 miles of the international border. |
|---|
| 15 | 15 | | (2) "Border security" means the detection and |
|---|
| 16 | 16 | | interdiction of all smuggling events between the ports of entry |
|---|
| 17 | 17 | | along the Texas-Mexico border. |
|---|
| 18 | 18 | | (3) "Border-related criminal activity" includes the |
|---|
| 19 | 19 | | smuggling of people, drugs, money, weapons, stolen vehicles, and |
|---|
| 20 | 20 | | other contraband, human trafficking, kidnapping, extortion, home |
|---|
| 21 | 21 | | invasion, corruption, murder, assault, arson, money laundering, |
|---|
| 22 | 22 | | impersonation of a law enforcement officer, vehicle theft, felony |
|---|
| 23 | 23 | | pursuits, and any other criminal activity conducted by or as a |
|---|
| 24 | 24 | | result of a transnational criminal organization engaging in |
|---|
| 25 | 25 | | cross-border illegal activity. |
|---|
| 26 | 26 | | (b) The Department of Public Safety, Texas Military |
|---|
| 27 | 27 | | Department, Parks and Wildlife Department, trusteed programs |
|---|
| 28 | 28 | | within the governor's office, Texas Department of Criminal Justice, |
|---|
| 29 | 29 | | and any other state agency designated by the board shall report to |
|---|
| 30 | 30 | | the board twice each state fiscal year the following: |
|---|
| 31 | 31 | | (1) the amount of money the agency budgeted for border |
|---|
| 32 | 32 | | security, the amount of money the agency spent on border security, |
|---|
| 33 | 33 | | and the agency's performance related to border security during the |
|---|
| 34 | 34 | | reporting period; |
|---|
| 35 | 35 | | (2) the finance method for budgeted and expended |
|---|
| 36 | 36 | | amounts; |
|---|
| 37 | 37 | | (3) the object of expense for budgeted and expended |
|---|
| 38 | 38 | | amounts; and |
|---|
| 39 | 39 | | (4) the amount of money spent on employee salaries for |
|---|
| 40 | 40 | | duties related to border security, including regular and overtime |
|---|
| 41 | 41 | | pay. |
|---|
| 42 | 42 | | (c) A state agency required by Subsection (b) to report |
|---|
| 43 | 43 | | information to the board shall submit information for the first |
|---|
| 44 | 44 | | half of the state fiscal year not later than February 28 and |
|---|
| 45 | 45 | | information for the second half of the state fiscal year not later |
|---|
| 46 | 46 | | than September 30. The state agency shall submit the information in |
|---|
| 47 | 47 | | the manner prescribed by the board. |
|---|
| 48 | 48 | | SECTION 2. This Act takes effect September 1, 2015. |
