| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Section 65.051(a), Election Code, is amended to |

| 12 | 10 | | read as follows: |

| 13 | 11 | | (a) The early voting ballot board shall verify and count |
|---|
| 14 | 12 | | provisional ballots as provided by this subchapter not later than |
|---|
| 15 | 13 | | the ninth [seventh] day after the date of an election. |
|---|
| 16 | 14 | | SECTION 2. Subchapter G, Chapter 87, Election Code, is |
|---|
| 17 | 15 | | amended by adding Section 87.127 to read as follows: |

| 18 | 16 | | Sec. 87.127. RESOLUTION OF INCORRECT DETERMINATION BY EARLY |
|---|
| 19 | 17 | | VOTING BALLOT BOARD. If a county election officer, as defined by |
|---|
| 20 | 18 | | Section 31.091, determines a ballot was incorrectly rejected by the |
|---|
| 21 | 19 | | early voting ballot board before the time set for convening the |
|---|
| 22 | 20 | | canvassing authority, the county election officer may petition a |
|---|
| 23 | 21 | | district court for injunctive or other relief as the court |
|---|
| 24 | 22 | | determines appropriate. |

| 25 | 23 | | SECTION 3. This Act takes effect September 1, 2015. |
