66 AN ACT
77 relating to the authority of school districts in certain counties
88 to grant housing stipends to teachers employed by the districts and
99 receive state reimbursement of those costs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 45.105, Education Code, is amended by
1212 adding Subsection (g) to read as follows:
1313 (g) An independent school district in a county where the
1414 number of permits issued by the Railroad Commission of Texas for oil
1515 or gas drilling within the county has increased by 25 percent or
1616 more over the preceding five-year period may use local and state
1717 school funds not designated for a specific purpose to provide
1818 stipends for housing to teachers employed by the district.
1919 SECTION 2. Subchapter E, Chapter 42, Education Code, is
2020 amended by adding Section 42.2528 to read as follows:
2121 Sec. 42.2528. REIMBURSEMENT FOR TEACHER HOUSING STIPENDS.
2222 (a) For each school year, from funds that may be used for the
2323 purpose, a school district that is authorized to provide housing
2424 stipends to teachers under Section 45.105(g) may apply to the
2525 commissioner for reimbursement of the cost of housing stipends
2626 provided to teachers by the district.
2727 (b) The reimbursement for which a district may apply under
2828 this section is in addition to the amount of revenue to which the
2929 district is entitled under Section 42.2516(b). This subsection
3030 expires September 1, 2017.
3131 (c) The commissioner may adopt rules as necessary to
3232 administer this section.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2015.
