| 7 | 7 | | relating to the authority of school districts in certain counties |

| 8 | 8 | | to grant housing stipends to teachers employed by the districts and |
|---|
| 9 | 9 | | receive state reimbursement of those costs. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 45.105, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (g) to read as follows: |
|---|
| 13 | 13 | | (g) An independent school district in a county where the |
|---|
| 14 | 14 | | number of permits issued by the Railroad Commission of Texas for oil |
|---|
| 15 | 15 | | or gas drilling within the county has increased by 25 percent or |
|---|
| 16 | 16 | | more over the preceding five-year period may use local and state |
|---|
| 17 | 17 | | school funds not designated for a specific purpose to provide |
|---|
| 18 | 18 | | stipends for housing to teachers employed by the district. |

| 19 | 19 | | SECTION 2. Subchapter E, Chapter 42, Education Code, is |
|---|
| 20 | 20 | | amended by adding Section 42.2528 to read as follows: |
|---|
| 21 | 21 | | Sec. 42.2528. REIMBURSEMENT FOR TEACHER HOUSING STIPENDS. |
|---|
| 22 | 22 | | (a) For each school year, from funds that may be used for the |
|---|
| 23 | 23 | | purpose, a school district that is authorized to provide housing |
|---|
| 24 | 24 | | stipends to teachers under Section 45.105(g) may apply to the |
|---|
| 25 | 25 | | commissioner for reimbursement of the cost of housing stipends |
|---|
| 26 | 26 | | provided to teachers by the district. |
|---|
| 27 | 27 | | (b) The reimbursement for which a district may apply under |
|---|
| 28 | 28 | | this section is in addition to the amount of revenue to which the |
|---|
| 29 | 29 | | district is entitled under Section 42.2516(b). This subsection |
|---|
| 30 | 30 | | expires September 1, 2017. |
|---|
| 31 | 31 | | (c) The commissioner may adopt rules as necessary to |
|---|
| 32 | 32 | | administer this section. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
