104 AN ACT
115 relating to the qualifications of directors and the use of project
126 funds of certain municipal development districts.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 377.051, Local Government Code, is
159 amended by adding Subsection (e) to read as follows:
1610 (e) Notwithstanding Subsection (d), a person may qualify to
1711 serve as a director of a district that is located in a municipality
1812 with a population of more than 5,000 and less than 6,000 and that is
1913 located wholly in a county with a population of more than 20,000 and
2014 less than 25,000 and that borders the Brazos River if the person
2115 resides in the independent school district that serves the majority
2216 of the district.
2317 SECTION 2. Section 377.072, Local Government Code, is
2418 amended by amending Subsection (c) and adding Subsection (e) to
2519 read as follows:
2620 (c) Except as provided by Subsections [Subsection] (d) and
2721 (e), the district may use money in the development project fund only
2822 to:
2923 (1) pay the costs of planning, acquiring,
3024 establishing, developing, constructing, or renovating one or more
3125 development projects in the district;
3226 (2) pay the principal of, interest on, and other costs
3327 relating to bonds or other obligations issued by the district or to
3428 refund bonds or other obligations; or
3529 (3) pay the costs of operating or maintaining one or
3630 more development projects during the planning, acquisition,
3731 establishment, development, construction, or renovation or while
3832 bonds or other obligations for the planning, acquisition,
3933 establishment, development, construction, or renovation are
4034 outstanding.
4135 (e) A district that is located in a municipality with a
4236 population of more than 5,000 and less than 6,000 and that is
4337 located wholly in a county with a population of more than 20,000 and
4438 less than 25,000 and that borders the Brazos River may use money in
4539 the development project fund only to:
4640 (1) pay the costs of planning, acquiring,
4741 establishing, developing, constructing, or renovating one or more
4842 development projects inside the county in which the district is
4943 located, if the project:
5044 (A) accomplishes a public purpose of the
5145 district;
5246 (B) allows the district to retain control over
5347 the money to ensure that the district's public purpose is
5448 accomplished and to protect the district's investment; and
5549 (C) benefits the district;
5650 (2) pay the principal of, interest on, and other costs
5751 relating to bonds or other obligations issued by the district or to
5852 refund bonds or other obligations; or
5953 (3) pay the costs of operating or maintaining one or
6054 more development projects during the planning, acquisition,
6155 establishment, development, construction, or renovation or while
6256 bonds or other obligations for the planning, acquisition,
6357 establishment, development, construction, or renovation are
6458 outstanding.
6559 SECTION 3. This Act takes effect immediately if it receives
6660 a vote of two-thirds of all the members elected to each house, as
6761 provided by Section 39, Article III, Texas Constitution. If this
6862 Act does not receive the vote necessary for immediate effect, this
6963 Act takes effect September 1, 2015.
