77 relating to the use of public information for marketing purposes;
88 creating a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 16, Business & Commerce Code,
1111 is amended by adding Chapter 762 to read as follows:
1212 CHAPTER 762. USE OF PUBLIC INFORMATION FOR MARKETING PURPOSE
1313 Sec. 762.001. USE OF PUBLIC INFORMATION FOR MARKETING
1414 PURPOSE PROHIBITED. A person may not use information received in
1515 response to a request for public information under Chapter 552,
1616 Government Code, for marketing purposes.
1717 Sec. 762.002. CIVIL PENALTY. (a) A person who violates
1818 this chapter is liable to the state for a civil penalty in an amount
1919 not to exceed $50 for each violation of this chapter.
2020 (b) The attorney general or appropriate prosecuting
2121 attorney may file suit to collect a civil penalty under this
2222 section.
2323 (c) The attorney general may bring an action in the name of
2424 the state to restrain or enjoin a violation or threatened violation
2525 of this chapter.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2015.
