55 AN ACT
66 relating to rights to appeal rate and damage schedule
77 determinations by the Board of Regents governing certain easements
88 or other interests in land of The University of Texas System.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 66.46(m), Education Code, is amended to
1111 read as follows:
1212 (m) the board of regents shall establish procedures by which
1313 a person seeking an easement or other interest under this section
1414 may seek relief from a rate or damage schedule that the person
1515 believes does not represent the fair market value of the interest
1616 being sought. Within 30 days of receiving notice of the board of
1717 regents' final determination, a person aggrieved by the final
1818 determination my appeal to a district court in a county in which the
1919 easement or other interest is located, for de novo review.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2015.
