55 AN ACT
66 relating to the authority of a political subdivision to regulate an
77 activity over which the Railroad Commission of Texas has
88 jurisdiction.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 81, Natural Resources
1111 Code, is amended by adding Section 81.0523 to read as follows:
1212 Sec. 81.0523. POLITICAL SUBDIVISION AUTHORITY. (a) A
1313 political subdivision may adopt or enforce an order, ordinance, or
1414 similar measure that applies to a person or operation over whom or
1515 which the commission has jurisdiction under this title only as
1616 provided by this section.
1717 (b) The commission has exclusive jurisdiction to determine
1818 whether the adoption or enforcement by a political subdivision of
1919 an order, ordinance, or similar measure applies to a person or
2020 operation over whom or which the commission has jurisdiction under
2121 this title.
2222 (c) A political subdivision shall petition the commission
2323 for permission before adopting or enforcing an ordinance, order, or
2424 similar measure described by Subsection (a).
2525 (d) The commission may grant a petition only if the
2626 political subdivision offers proof satisfactory to the commission
2727 that the ordinance, order, or similar measure is reasonable and
2828 enhances public safety.
2929 (e) This section does not apply to an ordinance, order, or
3030 similar measure described by Subsection (a) that is authorized by a
3131 state agency other than the commission.
3232 (f) A provision of this title that affirms the authority of
3333 or grants authority to a political subdivision to regulate a person
3434 or operation over whom or which the commission has jurisdiction
3535 under this title does not exempt the political subdivision from
3636 complying with this section.
3737 SECTION 2. Subchapter B, Chapter 121, Utilities Code, is
3838 amended by adding Section 121.053 to read as follows:
3939 Sec. 121.053. POLITICAL SUBDIVISION AUTHORITY. (a) A
4040 political subdivision may adopt or enforce an order, ordinance, or
4141 similar measure that applies to any aspect or phase of the gas
4242 pipeline industry only as provided by this section.
4343 (b) The railroad commission has exclusive
4444 jurisdiction to
4545 determine whether the adoption or enforcement by a political
4646 subdivision of an order, ordinance, or similar measure applies to
4747 any aspect or phase of the gas pipeline industry.
4848 (c) A political subdivision shall petition the railroad
4949 commission for permission before adopting or enforcing an
5050 ordinance, order, or similar measure described by Subsection (a).
5151 (d) The railroad commission may grant a petition only if the
5252 political subdivision offers proof satisfactory to the railroad
5353 commission that the ordinance, order, or similar measure is
5454 reasonable and enhances public safety.
5555 (e) This section does not apply to an ordinance, order, or
5656 similar measure described by Subsection (a) that is authorized by a
5757 state agency other than the railroad commission.
5858 (f) A provision of this chapter that affirms the authority
5959 of or grants authority to a political subdivision to regulate any
6060 aspect or phase of the gas pipeline industry does not exempt the
6161 political subdivision from complying with this section.
6262 SECTION 3. Section 113.054, Natural Resources Code, is
6363 repealed.
6464 SECTION 4. Sections 81.0523, Natural Resources Code, and
6565 121.053, Utilities Code, as added by this Act, apply to an
6666 ordinance, order, or similar measure adopted by a political
6767 subdivision before, on, or after the effective date of this Act.
6868 SECTION 5. This Act takes effect September 1, 2015.
