66 AN ACT
77 relating to the adjustment under the public school finance system
88 for optional homestead exemptions granted by public school
99 districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 42.2522(a) and (d), Education Code, are
1212 amended to read as follows:
1313 (a) In any school year, the commissioner shall [may not]
1414 provide funding under this chapter based on a school district's
1515 taxable value of property computed in accordance with Section
1616 403.302(d)(2), Government Code, but only if [unless]:
1717 (1) funds are specifically appropriated for purposes
1818 of this section; or
1919 (2) the commissioner determines that the total amount
2020 of state funds appropriated for purposes of the Foundation School
2121 Program for the school year exceeds the amount of state funds
2222 distributed to school districts in accordance with Section 42.253
2323 based on the taxable values of property in school districts
2424 computed in accordance with Section 403.302(d), Government Code,
2525 without any deduction for residence homestead exemptions granted
2626 under Section 11.13(n), Tax Code.
2727 (d) If the commissioner determines that the amount of funds
2828 available under Subsection (a)(1) or (2) does not at least equal the
2929 total amount of state funding to which districts would be entitled
3030 if state funding under this chapter were based on the taxable values
3131 of property in school districts computed in accordance with Section
3232 403.302(d)(2), Government Code, the commissioner shall [may, to the
3333 extent necessary,] provide state funding based on a uniform lesser
3434 fraction of the deduction under Section 403.302(d)(2), Government
3535 Code.
3636 SECTION 2. This Act takes effect September 1, 2015.
