| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subtitle A, Title 9, Health and Safety Code, is |
|---|
| 13 | 13 | | amended by adding Chapter 769 to read as follows: |
|---|
| 14 | 14 | | CHAPTER 769. RECREATIONAL VEHICLE PARKS AND CAMPGROUNDS |
|---|
| 15 | 15 | | CONSTRUCTION STANDARDS |
|---|
| 16 | 16 | | Sec. 769.001. DEFINITIONS. In this chapter: |
|---|
| 17 | 17 | | (1) "Governmental entity" means the state, an agency |
|---|
| 18 | 18 | | of the state, or a political subdivision of the state. |
|---|
| 19 | 19 | | (2) "NFPA" means the National Fire Protection |
|---|
| 20 | 20 | | Association. |
|---|
| 21 | 21 | | Sec. 769.002. APPLICABILITY. This chapter applies to a |
|---|
| 22 | 22 | | campground or recreational vehicle park consisting of a privately |
|---|
| 23 | 23 | | owned parcel or tract of land under the control of a person, |
|---|
| 24 | 24 | | organization, or other entity, other than a governmental entity, on |
|---|
| 25 | 25 | | which sites for recreational vehicles, recreational park trailers, |
|---|
| 26 | 26 | | or other camping units are offered primarily for transient guest |
|---|
| 27 | 27 | | use by the public or members of an organization for overnight stays. |
|---|
| 28 | 28 | | Sec. 769.003. MINIMUM STANDARDS. A campground or |
|---|
| 29 | 29 | | recreational vehicle park to which this chapter applies must comply |
|---|
| 30 | 30 | | with the NFPA 1194, Standard for Recreational Vehicle Parks and |
|---|
| 31 | 31 | | Campgrounds, 2014 Edition, other than Section 1.1.1. |
|---|
| 32 | 32 | | Sec. 769.004. EFFECT OF OTHER LAW. A governmental entity |
|---|
| 33 | 33 | | may adopt a law, policy, rule, regulation, ordinance, or order that |
|---|
| 34 | 34 | | regulates environmental health and sanitation, safety of |
|---|
| 35 | 35 | | electrical distribution systems, safety of liquefied petroleum gas |
|---|
| 36 | 36 | | storage and dispensing, or fire protection, provided that the law, |
|---|
| 37 | 37 | | policy, rule, regulation, ordinance, or order does not impose |
|---|
| 38 | 38 | | standards more stringent than the standards under Section 769.003. |
|---|
| 39 | 39 | | SECTION 2. (a) Notwithstanding Chapter 769, Health and |
|---|
| 40 | 40 | | Safety Code, as added by this Act, a recreational vehicle park or |
|---|
| 41 | 41 | | campground to which that chapter applies operating on the effective |
|---|
| 42 | 42 | | date of this Act is not required to comply with that chapter before |
|---|
| 43 | 43 | | September 1, 2016. |
|---|
| 44 | 44 | | (b) Notwithstanding Section 769.004, Health and Safety |
|---|
| 45 | 45 | | Code, as added by this Act, a recreational vehicle park or |
|---|
| 46 | 46 | | campground described by Subsection (a) of this section, during the |
|---|
| 47 | 47 | | period following the effective date of this Act until the date the |
|---|
| 48 | 48 | | recreational vehicle park or campground is in compliance with |
|---|
| 49 | 49 | | Chapter 769, Health and Safety Code, as added by this Act, is |
|---|
| 50 | 50 | | subject to any other state or local laws, policies, rules, |
|---|
| 51 | 51 | | regulations, ordinances, or orders applicable to a recreational |
|---|
| 52 | 52 | | vehicle park or campground. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2015. |
