99 relating to construction standards for certain recreational
1010 vehicle parks and campgrounds.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 9, Health and Safety Code, is
1313 amended by adding Chapter 769 to read as follows:
1414 CHAPTER 769. RECREATIONAL VEHICLE PARKS AND CAMPGROUNDS
1515 CONSTRUCTION STANDARDS
1616 Sec. 769.001. DEFINITIONS. In this chapter:
1717 (1) "Governmental entity" means the state, an agency
1818 of the state, or a political subdivision of the state.
1919 (2) "NFPA" means the National Fire Protection
2020 Association.
2121 Sec. 769.002. APPLICABILITY. This chapter applies to a
2222 campground or recreational vehicle park consisting of a privately
2323 owned parcel or tract of land under the control of a person,
2424 organization, or other entity, other than a governmental entity, on
2525 which sites for recreational vehicles, recreational park trailers,
2626 or other camping units are offered primarily for transient guest
2727 use by the public or members of an organization for overnight stays.
2828 Sec. 769.003. MINIMUM STANDARDS. A campground or
2929 recreational vehicle park to which this chapter applies must comply
3030 with the NFPA 1194, Standard for Recreational Vehicle Parks and
3131 Campgrounds, 2014 Edition, other than Section 1.1.1.
3232 Sec. 769.004. EFFECT OF OTHER LAW. A governmental entity
3333 may adopt a law, policy, rule, regulation, ordinance, or order that
3434 regulates environmental health and sanitation, safety of
3535 electrical distribution systems, safety of liquefied petroleum gas
3636 storage and dispensing, or fire protection, provided that the law,
3737 policy, rule, regulation, ordinance, or order does not impose
3838 standards more stringent than the standards under Section 769.003.
3939 SECTION 2. (a) Notwithstanding Chapter 769, Health and
4040 Safety Code, as added by this Act, a recreational vehicle park or
4141 campground to which that chapter applies operating on the effective
4242 date of this Act is not required to comply with that chapter before
4343 September 1, 2016.
4444 (b) Notwithstanding Section 769.004, Health and Safety
4545 Code, as added by this Act, a recreational vehicle park or
4646 campground described by Subsection (a) of this section, during the
4747 period following the effective date of this Act until the date the
4848 recreational vehicle park or campground is in compliance with
4949 Chapter 769, Health and Safety Code, as added by this Act, is
5050 subject to any other state or local laws, policies, rules,
5151 regulations, ordinances, or orders applicable to a recreational
5252 vehicle park or campground.
5353 SECTION 3. This Act takes effect September 1, 2015.
