55 AN ACT
66 relating to the creation of a deer management program commission.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 63, Texas Parks and Wildlife Code, is
99 amended by adding Section 63.003, to read as follows:
1010 Section 63.003. DEER MANAGEMENT COMMISSION. (a) In this
1111 section:
1212 (1) "Commission" means the deer management
1313 commission;
1414 (2) "Deer" means a white-tailed deer or mule deer;
1515 (3) "Department" means the Parks and Wildlife
1616 Department.
1717 (b) The commission is composed of the following nineteen
1818 members:
1919 (1) two veterinarians who are members of the Texas
2020 Deer Association, one whom shall be appointed by the speaker of the
2121 house of representatives and one whom shall be appointed by the
2222 lieutenant governor;
2323 (2) two wildlife biologists who are members of the
2424 Texas Deer Association, one whom shall be appointed by the speaker
2525 of the house of representatives and one whom shall be appointed by
2626 the lieutenant governor;
2727 (3) two veterinarians who are members of the Texas
2828 Wildlife Association, one whom shall be appointed by the speaker of
2929 the house of representatives and one whom shall be appointed by the
3030 lieutenant governor;
3131 (3) two wildlife biologists who are members of the
3232 Texas Wildlife Association, one whom shall be appointed by the
3333 speaker of the house of representatives and one whom shall be
3434 appointed by the lieutenant governor;
3535 (4) two representatives from the Texas Parks and
3636 Wildlife Department;
3737 (4) two representatives from the Texas Animal Health
3838 Commission;
3939 (5) two representatives from Texas A&M University, one
4040 whom shall be appointed by the speaker of the house of
4141 representatives and one whom shall be appointed by the lieutenant
4242 governor;
4343 (6) two representatives of Texas A&M University -
4444 Kingsville, one whom shall be appointed by the speaker of the house
4545 of representatives and one whom shall be appointed by the
4646 lieutenant governor;
4747 (7) two representatives of Texas Tech University, one
4848 whom shall be appointed by the speaker of the house of
4949 representatives and one whom shall be appointed by the lieutenant
5050 governor; and
5151 (8) the governor shall appoint a member of the public
5252 who has demonstrated a high knowledge of deer management to serve as
5353 the chair of the commission. The chair may not be a member of the
5454 Texas Deer Association or the Texas Wildlife Association.
5555 (c) The commission shall study and make recommendations
5656 regarding deer management practices for both white-tailed and mule
5757 deer, including:
5858 (1) study and determine exact pharmaceutical
5959 withdrawal periods;
6060 (2) study and develop guidelines for the denial and
6161 review of deer breeder permits;
6262 (3) study and recommend practices for the
6363 identification of breeder deer;
6464 (4) study and recommend practices for captivity of
6565 breeder deer;
6666 (5) study and recommend practices for the transfer of
6767 breeder deer;
6868 (6) study and recommend practices for the sale of game
6969 meat;
7070 (7) study and recommend practices for the trapping of
7171 deer;
7272 (8) recommend guidelines for the notification and
7373 appeal process regarding the depopulation of some or all of a deer
7474 breeder's herd; and
7575 (9) recommend a date for the release of breeder deer
7676 prior to an open hunting season.
7777 (d) A commission member is not entitled to compensation for
7878 the services provided as a commission member. A commission member
7979 may receive reimbursement for the member's actual and necessary
8080 expenses incurred in performing commission duties.
8181 (e) The Texas Parks and Wildlife Department and the Texas
8282 Animal Health Commission shall use existing resources to conduct
8383 the study.
8484 (f) The commission may solicit and accept donations from
8585 private and public sources for the purpose of this section.
8686 (g) The commission shall meet at the call of the presiding
8787 officer and may hold additional meetings by telephone conference
8888 call if necessary.
8989 (h) The commission shall hold at least three public hearings
9090 in locations selected by the commission to provide interested
9191 persons an opportunity to appear and speak on any subject relating
9292 to the powers and duties of the commission.
9393 (i) Not later than January 1, 2017, the commission shall
9494 provide the department, the legislature, and the governor, a final
9595 report on deer management recommendations.
9696 (j) Not later than January 1, 2019, the commission shall
9797 provide the department, the legislature, and the governor, a final
9898 report on the implementation of deer management practices.
9999 (k) This Section expires and the commission is abolished on
100100 June 1, 2019.
101101 (l) Not later than December 1, 2015, the governor shall
102102 appoint the chair of the commission, the speaker of the house of
103103 representatives, and the lieutenant governor shall appoint the
104104 members of the commission created under this section.
105105 (m) The commission is subject to Chapters 551 and 552,
106106 Government Code.
107107 SECTION 2. EFFECTIVE DATE. This Act takes effect
108108 immediately if it receives a vote of two-thirds of all the members
109109 elected to each house, as provided by Section 39, Article III, Texas
110110 Constitution. If this Act does not receive the vote necessary for
111111 immediate effect, this Act takes effect September 1, 2015.
