55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of attempted murder.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.01, Penal Code, is amended by
1010 amending Subsection (d) and adding Subsection (e) to read as
1111 follows:
1212 (d) Except as provided by Subsection (e), an [An] offense
1313 under this section is one category lower than the offense
1414 attempted, and if the offense attempted is a state jail felony, the
1515 offense is a Class A misdemeanor.
1616 (e)(1) This subsection applies only to the attempted
1717 commission of an offense under Section 19.02 that would otherwise
1818 be punishable as a felony of the second degree under Subsection (d).
1919 (2) The maximum term of imprisonment for an offense
2020 described by Subdivision (1) is increased to 40 years if the actor
2121 causes serious bodily injury that results in a persistent
2222 vegetative state.
2323 SECTION 2. The change in law made by this Act applies only
2424 to an offense committed on or after the effective date of this Act.
2525 An offense committed before the effective date of this Act is
2626 governed by the law in effect when the offense was committed, and
2727 the former law is continued in effect for that purpose. For
2828 purposes of this section, an offense was committed before the
2929 effective date of this Act if any element of the offense was
3030 committed before that date.
3131 SECTION 3. This Act takes effect September 1, 2015.
