| 7 | 7 | | relating to the punishment for the offense of attempted murder. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 15.01, Penal Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (d) and adding Subsection (e) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (d) Except as provided by Subsection (e), an [An] offense |
|---|
| 13 | 13 | | under this section is one category lower than the offense |
|---|
| 14 | 14 | | attempted, and if the offense attempted is a state jail felony, the |
|---|
| 15 | 15 | | offense is a Class A misdemeanor. |
|---|
| 16 | 16 | | (e)(1) This subsection applies only to the attempted |
|---|
| 17 | 17 | | commission of an offense under Section 19.02 that would otherwise |
|---|
| 18 | 18 | | be punishable as a felony of the second degree under Subsection (d). |
|---|
| 19 | 19 | | (2) The maximum term of imprisonment for an offense |
|---|
| 20 | 20 | | described by Subdivision (1) is increased to 40 years if the actor |
|---|
| 21 | 21 | | causes serious bodily injury that results in a persistent |
|---|
| 22 | 22 | | vegetative state. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to an offense committed on or after the effective date of this Act. |
|---|
| 25 | 25 | | An offense committed before the effective date of this Act is |
|---|
| 26 | 26 | | governed by the law in effect when the offense was committed, and |
|---|
| 27 | 27 | | the former law is continued in effect for that purpose. For |
|---|
| 28 | 28 | | purposes of this section, an offense was committed before the |
|---|
| 29 | 29 | | effective date of this Act if any element of the offense was |
|---|
| 30 | 30 | | committed before that date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2015. |
