66 AN ACT
77 relating to the creation of a judicial district composed of Kendall
88 County, the composition of the 216th Judicial District, the
99 creation of a criminal district attorney of Kendall County, and the
1010 abolishment of the County Court at Law of Kendall County and the
1111 office of county attorney of Kendall County.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 24.275, Government Code, is amended to
1414 read as follows:
1515 Sec. 24.275. 216TH JUDICIAL DISTRICT (GILLESPIE[,
1616 KENDALL,] AND KERR COUNTIES). The 216th Judicial District is
1717 composed of Gillespie[, Kendall,] and Kerr counties.
1818 SECTION 2. Subchapter C, Chapter 24, Government Code, is
1919 amended by adding Section 24.591 to read as follows:
2020 Sec. 24.591. 451ST JUDICIAL DISTRICT (KENDALL COUNTY). (a)
2121 The 451st Judicial District is composed of Kendall County.
2222 (b) In addition to the other jurisdiction provided by law,
2323 the 451st District Court has concurrent jurisdiction with the
2424 County Court of Kendall County in all civil and criminal matters
2525 over which the county court would have original or appellate
2626 jurisdiction, including probate matters and proceedings under
2727 Subtitle C, Title 7, Health and Safety Code.
2828 (c) All civil and criminal matters within the concurrent
2929 jurisdiction of the county and district courts must be filed with
3030 the county clerk in the county court. The county clerk serves as
3131 the clerk of the district court for those matters.
3232 SECTION 3. Section 44.001, Government Code, is amended to
3333 read as follows:
3434 Sec. 44.001. ELECTION. The voters of each of the following
3535 counties elect a criminal district attorney: Anderson, Austin,
3636 Bastrop, Bexar, Bowie, Brazoria, Caldwell, Calhoun, Cass, Collin,
3737 Comal, Dallas, Deaf Smith, Denton, Eastland, Fannin, Galveston,
3838 Grayson, Gregg, Harrison, Hays, Hidalgo, Jackson, Jasper,
3939 Jefferson, Kaufman, Kendall, Lubbock, McLennan, Madison, Navarro,
4040 Newton, Panola, Polk, Randall, Rockwall, San Jacinto, Smith,
4141 Tarrant, Taylor, Tyler, Upshur, Van Zandt, Victoria, Walker,
4242 Waller, Wichita, Wood, and Yoakum.
4343 SECTION 4. Subchapter B, Chapter 44, Government Code, is
4444 amended by adding Section 44.230 to read as follows:
4545 Sec. 44.230. KENDALL COUNTY. (a) The criminal district
4646 attorney of Kendall County must meet the following qualifications:
4747 (1) be at least 30 years old;
4848 (2) have been a practicing attorney in this state for
4949 at least five years; and
5050 (3) have been a resident of Kendall County for at least
5151 one year before election or appointment.
5252 (b) The criminal district attorney has all the powers,
5353 duties, and privileges in Kendall County that are conferred by law
5454 on county and district attorneys in the various counties and
5555 districts.
5656 (c) The criminal district attorney shall attend each term
5757 and session of the district and inferior courts of Kendall County,
5858 except municipal courts, held for the transaction of criminal
5959 business and shall exclusively represent the state in all criminal
6060 matters before those courts.
6161 (d) The criminal district attorney shall represent Kendall
6262 County in any court in which the county has pending business. This
6363 subsection does not require the criminal district attorney to
6464 represent the county in a delinquent tax suit or condemnation
6565 proceeding and does not prevent the county from retaining other
6666 legal counsel in a civil matter at any time it considers appropriate
6767 to do so.
6868 (e) The criminal district attorney shall collect the fees,
6969 commissions, and perquisites that are provided by law for similar
7070 services rendered by a district or county attorney.
7171 (f) The criminal district attorney is entitled to receive in
7272 equal monthly installments compensation from the state equal to the
7373 amount paid by the state to district attorneys. The state
7474 compensation shall be paid by the comptroller as appropriated by
7575 the legislature. The Commissioners Court of Kendall County shall
7676 pay the criminal district attorney an additional amount so that the
7777 total compensation of the criminal district attorney equals at
7878 least 90 percent of the total salary paid to the judge of the 451st
7979 District Court in Kendall County. The compensation paid by the
8080 county shall be paid in semiweekly or bimonthly installments, as
8181 determined by the commissioners court.
8282 (g) The criminal district attorney or the Commissioners
8383 Court of Kendall County may accept gifts and grants from any
8484 individual, partnership, corporation, trust, foundation,
8585 association, or governmental entity for the purpose of financing or
8686 assisting effective prosecution, crime prevention or suppression,
8787 rehabilitation of offenders, substance abuse education, treatment
8888 and prevention, or crime victim assistance programs in Kendall
8989 County. The criminal district attorney shall account for and
9090 report to the commissioners court all gifts or grants accepted
9191 under this subsection.
9292 (h) The criminal district attorney, for the purpose of
9393 conducting affairs of the office, may appoint a staff composed of
9494 assistant criminal district attorneys, investigators,
9595 stenographers, clerks, and other personnel that the commissioners
9696 court may authorize. The salary of a staff member is an amount
9797 recommended by the criminal district attorney and approved by the
9898 commissioners court. The commissioners court shall pay the
9999 salaries of the staff in equal semiweekly or bimonthly installments
100100 from county funds.
101101 (i) The criminal district attorney shall, with the advice
102102 and consent of the commissioners court, designate one or more
103103 individuals to act as an assistant criminal district attorney with
104104 exclusive responsibility for assisting the commissioners court. An
105105 individual designated as an assistant criminal district attorney
106106 under this subsection must have extensive experience in
107107 representing public entities and knowledge of the laws affecting
108108 counties, including the open meetings and open records laws under
109109 Chapters 551 and 552.
110110 (j) Kendall County is entitled to receive from the state an
111111 amount equal to the amount provided in the General Appropriations
112112 Act to district attorneys for the payment of staff salaries and
113113 office expenses.
114114 (k) The legislature may provide for additional staff
115115 members to be paid from state funds if it considers supplementation
116116 of the criminal district attorney's staff to be necessary.
117117 (l) The criminal district attorney and assistant criminal
118118 district attorney may not engage in the private practice of law or
119119 receive a fee for the referral of a case.
120120 (m) A vacancy in the office of criminal district attorney is
121121 filled by appointment by the Commissioners Court of Kendall County.
122122 The appointee holds office until the next general election.
123123 SECTION 5. Section 46.002, Government Code, is amended to
124124 read as follows:
125125 Sec. 46.002. PROSECUTORS SUBJECT TO CHAPTER. This chapter
126126 applies to the state prosecuting attorney, all county prosecutors,
127127 and the following state prosecutors:
128128 (1) the district attorneys for Kenedy and Kleberg
129129 Counties and for the 1st, 2nd, 8th, 9th, 18th, 21st, 23rd, 25th,
130130 26th, 27th, 29th, 31st, 32nd, 33rd, 34th, 35th, 36th, 38th, 39th,
131131 42nd, 43rd, 46th, 47th, 49th, 50th, 51st, 52nd, 53rd, 63rd, 64th,
132132 66th, 69th, 70th, 76th, 79th, 81st, 83rd, 84th, 85th, 88th, 90th,
133133 97th, 100th, 105th, 106th, 109th, 110th, 112th, 118th, 119th,
134134 123rd, 142nd, 143rd, 145th, 156th, 159th, 173rd, 196th, 198th,
135135 216th, 220th, 229th, 235th, 253rd, 258th, 259th, 266th, 268th,
136136 271st, 286th, 287th, 329th, 344th, 349th, 355th, 369th, 452nd, and
137137 506th judicial districts;
138138 (2) the criminal district attorneys for the counties
139139 of Anderson, Austin, Bastrop, Bexar, Bowie, Brazoria, Caldwell,
140140 Calhoun, Cass, Collin, Comal, Dallas, Deaf Smith, Denton, Eastland,
141141 Fannin, Galveston, Grayson, Gregg, Harrison, Hays, Hidalgo,
142142 Jasper, Jefferson, Kaufman, Kendall, Lubbock, McLennan, Madison,
143143 Navarro, Newton, Panola, Polk, Randall, Rockwall, San Jacinto,
144144 Smith, Tarrant, Taylor, Tyler, Upshur, Van Zandt, Victoria, Walker,
145145 Waller, Wichita, Wood, and Yoakum; and
146146 (3) the county attorneys performing the duties of
147147 district attorneys in the counties of Andrews, Callahan, Cameron,
148148 Castro, Colorado, Crosby, Ellis, Falls, Freestone, Gonzales,
149149 Lamar, Lamb, Lampasas, Lavaca, Lee, Limestone, Marion, Milam,
150150 Morris, Ochiltree, Oldham, Orange, Rains, Red River, Robertson,
151151 Rusk, Swisher, Terry, Webb, and Willacy.
152152 SECTION 6. The office of county attorney of Kendall County
153153 is abolished.
154154 SECTION 7. Sections 25.1321 and 25.1322, Government Code,
155155 are repealed, and the County Court at Law of Kendall County is
156156 abolished on the date the 451st District Court is created.
157157 SECTION 8. On the date the 451st District Court is created,
158158 all cases from Kendall County pending in the 216th District Court
159159 are transferred to the 451st District Court. On the date the County
160160 Court at Law of Kendall County is abolished, all cases pending in
161161 the court are transferred to the 451st District Court. When a case
162162 is transferred from one court to another as provided by this
163163 section, all processes, writs, bonds, recognizances, or other
164164 obligations issued from the transferring court are returnable to
165165 the court to which the case is transferred as if originally issued
166166 by that court. The obligees in all bonds and recognizances taken in
167167 and for a court from which a case is transferred and all witnesses
168168 summoned to appear in a court from which a case is transferred are
169169 required to appear before the court to which a case is transferred
170170 as if originally required to appear before the court to which the
171171 transfer is made.
172172 SECTION 9. Notwithstanding Section 41.010, Government
173173 Code, the initial vacancy in the office of the criminal district
174174 attorney of Kendall County shall be filled by election. The office
175175 exists for purposes of the primary and general elections in 2016. A
176176 vacancy after the initial vacancy is filled as provided by Section
177177 12, Article IV, Texas Constitution.
178178 SECTION 10. Notwithstanding Section 24.026, Government
179179 Code, the initial vacancy in the office of judge of the 451st
180180 Judicial District shall be filled by election. The office exists
181181 for purposes of the primary and general elections in 2016. A
182182 vacancy after the initial vacancy is filled as provided by Section
183183 28, Article V, Texas Constitution.
184184 SECTION 11. The 451st Judicial District is created on the
185185 effective date of this Act.
186186 SECTION 12. This Act takes effect January 1, 2017.
