55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to inclusion of mental health concerns in existing school
88 health efforts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004, Education Code, is amended by
1111 amending Subsection (d) and adding Subsection (l-2) to read as
1212 follows:
1313 (d) The board of trustees shall appoint at least five
1414 members to the local school health advisory council. A majority of
1515 the members must be persons who are parents of students enrolled in
1616 the district and who are not employed by the district. One of those
1717 members shall serve as chair or co-chair of the council. The board
1818 of trustees also may appoint one or more persons from each of the
1919 following groups or a representative from a group other than a group
2020 specified under this subsection:
2121 (1) public school teachers;
2222 (2) public school administrators;
2323 (3) district students;
2424 (4) health care professionals;
2525 (5) the business community;
2626 (6) law enforcement;
2727 (7) senior citizens;
2828 (8) the clergy;
2929 (9) nonprofit health organizations; [and]
3030 (10) local domestic violence programs;
3131 (11) local community mental health providers; and
3232 (12) local substance abuse services providers.
3333 (l-2) The local school health advisory council shall:
3434 (1) review the adopted health education curriculum for
3535 accuracy and content related to mental health and consider the
3636 inclusion of the following topics:
3737 (A) recognition of signs and symptoms related to
3838 mental illness;
3939 (B) mental health stigmas;
4040 (C) substance abuse; and
4141 (D) stress management;
4242 (2) make recommendations regarding professional
4343 development designed to promote the ability of school district
4444 staff to build positive relationships with students, increase
4545 school connectedness, and improve recognition and understanding of
4646 mental health issues; and
4747 (3) make policy recommendations to the school district
4848 concerning the integration of social and emotional learning into
4949 the academic curriculum.
5050 SECTION 2. Section 38.013(a), Education Code, is amended to
5151 read as follows:
5252 (a) The agency shall make available to each school district
5353 one or more coordinated health programs designed to prevent
5454 obesity, cardiovascular disease, oral diseases, [and] Type 2
5555 diabetes, and mental health concerns in elementary school, middle
5656 school, and junior high school students. Each program must provide
5757 for coordinating:
5858 (1) health education, including oral health
5959 education;
6060 (2) physical education and physical activity;
6161 (3) nutrition services; [and]
6262 (4) parental involvement; and
6363 (5) physical and mental health policies, services, and
6464 supports.
6565 SECTION 3. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2015.
