| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter F, Chapter 43, Local Government Code, |
|---|
| 10 | 10 | | is amended by adding Section 43.1305 to read as follows: |

| 11 | 11 | | Sec. 43.1305. EFFECT OF ANNEXATION ON LAND USE REGULATION. |
|---|
| 12 | 12 | | (a) A municipality may not enforce an ordinance or rule that |
|---|
| 13 | 13 | | limits the number of people who may assemble on property located in |
|---|
| 14 | 14 | | an area that the municipality annexed for limited purposes if the |
|---|
| 15 | 15 | | ordinance or rule would restrict the number of people authorized to |
|---|
| 16 | 16 | | assemble on the property to less than what the fire prevention |
|---|
| 17 | 17 | | authority with jurisdiction over the property has authorized by |
|---|
| 18 | 18 | | permit. |
|---|
| 19 | 19 | | (b) In this section, "fire prevention authority" means a |
|---|
| 20 | 20 | | county fire marshal, a municipal fire department, an emergency |
|---|
| 21 | 21 | | services district, or any local agency that provides emergency |
|---|
| 22 | 22 | | medical services to the area. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2015. |
