| 15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 9 | | SECTION 1. Subchapter E, Chapter 1551, Insurance Code, is |
|---|
| 17 | 10 | | amended by adding Section 1551.227 to read as follows: |
|---|
| 18 | 11 | | Sec. 1551.227. TRICARE MILITARY HEALTH SYSTEM SUPPLEMENTAL |
|---|
| 19 | 12 | | PLAN. (a) The board of trustees shall make available a TRICARE |
|---|
| 20 | 13 | | Military Health System supplemental plan to an employee or |
|---|
| 21 | 14 | | annuitant who waives coverage under the basic coverage plan under |
|---|
| 22 | 15 | | Section 1551.1045 and is eligible for benefits under the TRICARE |
|---|
| 23 | 16 | | Military Health System. The board of trustees may not contribute to |
|---|
| 24 | 17 | | the cost of the supplemental plan, including the premium cost. |
|---|
| 25 | 18 | | (b) A plan offered under this section must be considered a |
|---|
| 26 | 19 | | permissible offering to TRICARE participants and beneficiaries |
|---|
| 27 | 20 | | under 10 U.S.C. Section 1097c. |
|---|
| 28 | 21 | | (c) The board of trustees may adopt rules necessary to |
|---|
| 29 | 22 | | implement this section, including rules regarding eligibility for |
|---|
| 30 | 23 | | the plan, available insurance products, and enrollment in the plan. |
|---|
| 31 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 28 | | Act takes effect September 1, 2015. |
