77 relating to the use of certain coins and bullion as legal tender.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle A, Title 15, Business & Commerce Code,
1010 is amended by adding Chapter 662 to read as follows:
1111 CHAPTER 662. GOLD AND SILVER COIN AND GOLD AND SILVER BULLION AS
1212 LEGAL TENDER
1313 Sec. 662.001. LEGAL TENDER IN THIS STATE. Gold and silver
1414 coin and gold and silver bullion are legal tender in this state to
1515 the extent allowable under Section 10, Article I, United States
1616 Constitution.
1717 Sec. 662.002. USE OF GOLD OR SILVER COIN OR GOLD OR SILVER
1818 BULLION. (a) A person may use gold or silver coin or gold or
1919 silver bullion as legal tender in this state for the payment of any
2020 private or public debt.
2121 (b) Notwithstanding Subsection (a), a person may not be
2222 compelled to accept or tender gold or silver coin or gold or silver
2323 bullion.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2015.
