9 | 9 | SECTION 1. Subtitle A, Title 15, Business & Commerce Code, | |
10 | 10 | is amended by adding Chapter 662 to read as follows: | |
11 | 11 | CHAPTER 662. GOLD AND SILVER COIN AND GOLD AND SILVER BULLION AS | |
12 | 12 | LEGAL TENDER | |
13 | 13 | Sec. 662.001. LEGAL TENDER IN THIS STATE. Gold and silver | |
14 | 14 | coin and gold and silver bullion are legal tender in this state to | |
15 | 15 | the extent allowable under Section 10, Article I, United States | |
16 | 16 | Constitution. | |
17 | 17 | Sec. 662.002. USE OF GOLD OR SILVER COIN OR GOLD OR SILVER | |
18 | 18 | BULLION. (a) A person may use gold or silver coin or gold or | |
19 | 19 | silver bullion as legal tender in this state for the payment of any | |
20 | 20 | private or public debt. | |
21 | 21 | (b) Notwithstanding Subsection (a), a person may not be | |
22 | 22 | compelled to accept or tender gold or silver coin or gold or silver | |
23 | 23 | bullion. | |
24 | 24 | SECTION 2. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect September 1, 2015. |
