| 7 | 7 | | relating to the establishment of the University of Houston-Katy |

| 8 | 8 | | campus and authorization for the issuance of revenue bonds to fund |
|---|
| 9 | 9 | | an academic building at the campus. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 111, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subchapter J to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER J. THE UNIVERSITY OF HOUSTON-KATY |
|---|
| 14 | 14 | | Sec. 111.131. UNIVERSITY OF HOUSTON-KATY. There is |
|---|
| 15 | 15 | | established in Harris County a coeducational institution of higher |
|---|
| 16 | 16 | | education to be known as the University of Houston-Katy. The |
|---|
| 17 | 17 | | institution shall be located on land currently owned by the |
|---|
| 18 | 18 | | University of Houston System, land purchased by the University of |
|---|
| 19 | 19 | | Houston System, or land acquired by the University of Houston |
|---|
| 20 | 20 | | System by donation. |
|---|
| 21 | 21 | | Sec. 111.132. ORGANIZATION AND CONTROL. The organization |
|---|
| 22 | 22 | | and control of the University of Houston-Katy are vested in the |
|---|
| 23 | 23 | | board of regents of the University of Houston System. The board of |
|---|
| 24 | 24 | | regents has all rights, powers, and duties with respect to the |
|---|
| 25 | 25 | | University of Houston-Katy that it has with respect to the |
|---|
| 26 | 26 | | organization and control of the University of Houston, except as |
|---|
| 27 | 27 | | otherwise provided by this subchapter. |
|---|
| 28 | 28 | | Sec. 111.133. ROLE AND SCOPE. The University of |
|---|
| 29 | 29 | | Houston-Katy shall offer undergraduate and graduate programs. |
|---|
| 30 | 30 | | Sec. 111.134. GIFTS AND GRANTS. The board of regents of the |
|---|
| 31 | 31 | | University of Houston System may accept and administer gifts and |
|---|
| 32 | 32 | | grants for the use and benefit of the University of Houston-Katy. |
|---|
| 33 | 33 | | SECTION 2. Subchapter B, Chapter 55, Education Code, is |
|---|
| 34 | 34 | | amended by adding Section 55.178312 to read as follows: |
|---|
| 35 | 35 | | Sec. 55.178312. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL |
|---|
| 36 | 36 | | BONDS. (a) In addition to the other authority granted by this |
|---|
| 37 | 37 | | subchapter, the board of regents of the University of Houston |
|---|
| 38 | 38 | | System may acquire, purchase, construct, improve, renovate, |
|---|
| 39 | 39 | | enlarge, or equip property and facilities, including roads and |
|---|
| 40 | 40 | | related infrastructure, for an academic building located in Harris |
|---|
| 41 | 41 | | County in or near Katy, Texas, to be financed through the issuance |
|---|
| 42 | 42 | | of bonds in accordance with this subchapter, including bonds issued |
|---|
| 43 | 43 | | in accordance with a systemwide revenue financing program and |
|---|
| 44 | 44 | | secured as provided by that program, in an aggregate principal |
|---|
| 45 | 45 | | amount not to exceed $58,540,000. |
|---|
| 46 | 46 | | (b) The board may pledge irrevocably to the payment of bonds |
|---|
| 47 | 47 | | authorized by this section all or any part of the revenue funds of |
|---|
| 48 | 48 | | an institution, branch, or entity of the University of Houston |
|---|
| 49 | 49 | | System, including student tuition charges. The amount of a pledge |
|---|
| 50 | 50 | | made under this subsection may not be reduced or abrogated while the |
|---|
| 51 | 51 | | bonds for which the pledge is made, or bonds issued to refund those |
|---|
| 52 | 52 | | bonds, are outstanding. |
|---|
| 53 | 53 | | (c) If sufficient funds are not available to the board to |
|---|
| 54 | 54 | | meet its obligations under this section, the board may transfer |
|---|
| 55 | 55 | | funds among institutions, branches, and entities of the University |
|---|
| 56 | 56 | | of Houston System to ensure the most equitable and efficient |
|---|
| 57 | 57 | | allocation of available resources for each institution, branch, or |
|---|
| 58 | 58 | | entity to carry out its duties and purposes. |
|---|
| 59 | 59 | | SECTION 3. The board of regents of the University of Houston |
|---|
| 60 | 60 | | System, as soon as practicable following the effective date of this |
|---|
| 61 | 61 | | Act consistent with available resources and any required approval |
|---|
| 62 | 62 | | by the Texas Higher Education Coordinating Board, shall establish |
|---|
| 63 | 63 | | the University of Houston-Katy in accordance with this Act. |
|---|
| 64 | 64 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 68 | 68 | | Act takes effect September 1, 2015. |
