55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the University of Houston-Katy
88 campus and authorization for the issuance of revenue bonds to fund
99 an academic building at the campus.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 111, Education Code, is amended by
1212 adding Subchapter J to read as follows:
1313 SUBCHAPTER J. THE UNIVERSITY OF HOUSTON-KATY
1414 Sec. 111.131. UNIVERSITY OF HOUSTON-KATY. There is
1515 established in Harris County a coeducational institution of higher
1616 education to be known as the University of Houston-Katy. The
1717 institution shall be located on land currently owned by the
1818 University of Houston System, land purchased by the University of
1919 Houston System, or land acquired by the University of Houston
2020 System by donation.
2121 Sec. 111.132. ORGANIZATION AND CONTROL. The organization
2222 and control of the University of Houston-Katy are vested in the
2323 board of regents of the University of Houston System. The board of
2424 regents has all rights, powers, and duties with respect to the
2525 University of Houston-Katy that it has with respect to the
2626 organization and control of the University of Houston, except as
2727 otherwise provided by this subchapter.
2828 Sec. 111.133. ROLE AND SCOPE. The University of
2929 Houston-Katy shall offer undergraduate and graduate programs.
3030 Sec. 111.134. GIFTS AND GRANTS. The board of regents of the
3131 University of Houston System may accept and administer gifts and
3232 grants for the use and benefit of the University of Houston-Katy.
3333 SECTION 2. Subchapter B, Chapter 55, Education Code, is
3434 amended by adding Section 55.178312 to read as follows:
3535 Sec. 55.178312. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
3636 BONDS. (a) In addition to the other authority granted by this
3737 subchapter, the board of regents of the University of Houston
3838 System may acquire, purchase, construct, improve, renovate,
3939 enlarge, or equip property and facilities, including roads and
4040 related infrastructure, for an academic building located in Harris
4141 County in or near Katy, Texas, to be financed through the issuance
4242 of bonds in accordance with this subchapter, including bonds issued
4343 in accordance with a systemwide revenue financing program and
4444 secured as provided by that program, in an aggregate principal
4545 amount not to exceed $58,540,000.
4646 (b) The board may pledge irrevocably to the payment of bonds
4747 authorized by this section all or any part of the revenue funds of
4848 an institution, branch, or entity of the University of Houston
4949 System, including student tuition charges. The amount of a pledge
5050 made under this subsection may not be reduced or abrogated while the
5151 bonds for which the pledge is made, or bonds issued to refund those
5252 bonds, are outstanding.
5353 (c) If sufficient funds are not available to the board to
5454 meet its obligations under this section, the board may transfer
5555 funds among institutions, branches, and entities of the University
5656 of Houston System to ensure the most equitable and efficient
5757 allocation of available resources for each institution, branch, or
5858 entity to carry out its duties and purposes.
5959 SECTION 3. The board of regents of the University of Houston
6060 System, as soon as practicable following the effective date of this
6161 Act consistent with available resources and any required approval
6262 by the Texas Higher Education Coordinating Board, shall establish
6363 the University of Houston-Katy in accordance with this Act.
6464 SECTION 4. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2015.
