| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 35A.02, Penal Code, is amended by adding | |
| 11 | 11 | Subsection (g) to read as follows: | |
| 12 | 12 | (g) It is not a defense to prosecution under this section | |
| 13 | 13 | that the Medicaid program has received or recouped funds | |
| 14 | 14 | representing repayment, wholly or partly, for the fraudulent act or | |
| 15 | 15 | acts that are the basis for the criminal charge for which the | |
| 16 | 16 | defendant is indicted. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to an offense committed on or after the effective date of this Act. | |
| 19 | 19 | An offense committed before the effective date of this Act is | |
| 20 | 20 | governed by the law in effect on the date the offense was committed, | |
| 21 | 21 | and the former law is continued in effect for that purpose. For | |
| 22 | 22 | purposes of this section, an offense was committed before the | |
| 23 | 23 | effective date of this Act if any element of the offense occurred | |
| 24 | 24 | before that date. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2015. |
