55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution of the offense of Medicaid
88 fraud.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 35A.02, Penal Code, is amended by adding
1111 Subsection (g) to read as follows:
1212 (g) It is not a defense to prosecution under this section
1313 that the Medicaid program has received or recouped funds
1414 representing repayment, wholly or partly, for the fraudulent act or
1515 acts that are the basis for the criminal charge for which the
1616 defendant is indicted.
1717 SECTION 2. The change in law made by this Act applies only
1818 to an offense committed on or after the effective date of this Act.
1919 An offense committed before the effective date of this Act is
2020 governed by the law in effect on the date the offense was committed,
2121 and the former law is continued in effect for that purpose. For
2222 purposes of this section, an offense was committed before the
2323 effective date of this Act if any element of the offense occurred
2424 before that date.
2525 SECTION 3. This Act takes effect September 1, 2015.
