| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter I, Chapter 16, Water Code, is amended |
|---|
| 15 | 15 | | by adding Section 16.3151 to read as follows: |
|---|
| 16 | 16 | | Sec. 16.3151. FLOODPLAIN ADMINISTRATORS: DESIGNATION, |
|---|
| 17 | 17 | | FUNCTIONS, ACCREDITATION, AND CONTINUING EDUCATION. (a) The |
|---|
| 18 | 18 | | governing body of each city and county shall designate a floodplain |
|---|
| 19 | 19 | | administrator to administer and implement laws and regulations |
|---|
| 20 | 20 | | relating to the management of floodplains. |
|---|
| 21 | 21 | | (b) A floodplain administrator must be accredited by the |
|---|
| 22 | 22 | | board. |
|---|
| 23 | 23 | | (c) The board by rule shall establish accreditation |
|---|
| 24 | 24 | | standards for floodplain administrators. In establishing |
|---|
| 25 | 25 | | accreditation standards, the board shall consider the knowledge, |
|---|
| 26 | 26 | | experience, skills, and training necessary to prevent or minimize |
|---|
| 27 | 27 | | flood hazards and losses. Accreditation standards may require: |
|---|
| 28 | 28 | | (1) passage of an examination; |
|---|
| 29 | 29 | | (2) completion of approved training; or |
|---|
| 30 | 30 | | (3) certification by a nationally recognized |
|---|
| 31 | 31 | | floodplain management organization. |
|---|
| 32 | 32 | | (d) The board by rule shall establish requirements for |
|---|
| 33 | 33 | | mandatory continuing education or training for accredited |
|---|
| 34 | 34 | | floodplain administrators. Rules adopted under this subsection |
|---|
| 35 | 35 | | must require a floodplain administrator to complete not less than |
|---|
| 36 | 36 | | six hours of continuing education or training each year. |
|---|
| 37 | 37 | | (e) The board may adopt rules necessary to implement and |
|---|
| 38 | 38 | | enforce this section. |
|---|
| 39 | 39 | | SECTION 2. Section 16.3161(c), Water Code, is amended to |
|---|
| 40 | 40 | | read as follows: |
|---|
| 41 | 41 | | (c) The board may use the account to: |
|---|
| 42 | 42 | | (1) fund the performance of the board's functions |
|---|
| 43 | 43 | | under Section 16.316; and |
|---|
| 44 | 44 | | (2) provide initial or continuing education or |
|---|
| 45 | 45 | | training in order for floodplain administrators to obtain or |
|---|
| 46 | 46 | | maintain accreditation under Section 16.3151. |
|---|
| 47 | 47 | | SECTION 3. Section 16.3221(a), Water Code, is amended to |
|---|
| 48 | 48 | | read as follows: |
|---|
| 49 | 49 | | (a) A person commits an offense if the person violates this |
|---|
| 50 | 50 | | subchapter or a rule adopted or order issued under this subchapter. |
|---|
| 51 | 51 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 52 | 52 | | to a violation committed on or after the effective date of this Act. |
|---|
| 53 | 53 | | A violation committed before the effective date of this Act is |
|---|
| 54 | 54 | | governed by the law in effect on the date the violation was |
|---|
| 55 | 55 | | committed, and the former law is continued in effect for that |
|---|
| 56 | 56 | | purpose. For purposes of this section, a violation was committed |
|---|
| 57 | 57 | | before the effective date of this Act if any element of the |
|---|
| 58 | 58 | | violation occurred before that date. |
|---|
| 59 | 59 | | SECTION 5. This Act takes effect September 1, 2015. |
