88 AN ACT
99 relating to the administration and implementation of the Flood
1010 Control and Insurance Act; adding provisions subject to a civil or
1111 criminal penalty and affecting the prosecution of a criminal
1212 offense.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter I, Chapter 16, Water Code, is amended
1515 by adding Section 16.3151 to read as follows:
1616 Sec. 16.3151. FLOODPLAIN ADMINISTRATORS: DESIGNATION,
1717 FUNCTIONS, ACCREDITATION, AND CONTINUING EDUCATION. (a) The
1818 governing body of each city and county shall designate a floodplain
1919 administrator to administer and implement laws and regulations
2020 relating to the management of floodplains.
2121 (b) A floodplain administrator must be accredited by the
2222 board.
2323 (c) The board by rule shall establish accreditation
2424 standards for floodplain administrators. In establishing
2525 accreditation standards, the board shall consider the knowledge,
2626 experience, skills, and training necessary to prevent or minimize
2727 flood hazards and losses. Accreditation standards may require:
2828 (1) passage of an examination;
2929 (2) completion of approved training; or
3030 (3) certification by a nationally recognized
3131 floodplain management organization.
3232 (d) The board by rule shall establish requirements for
3333 mandatory continuing education or training for accredited
3434 floodplain administrators. Rules adopted under this subsection
3535 must require a floodplain administrator to complete not less than
3636 six hours of continuing education or training each year.
3737 (e) The board may adopt rules necessary to implement and
3838 enforce this section.
3939 SECTION 2. Section 16.3161(c), Water Code, is amended to
4040 read as follows:
4141 (c) The board may use the account to:
4242 (1) fund the performance of the board's functions
4343 under Section 16.316; and
4444 (2) provide initial or continuing education or
4545 training in order for floodplain administrators to obtain or
4646 maintain accreditation under Section 16.3151.
4747 SECTION 3. Section 16.3221(a), Water Code, is amended to
4848 read as follows:
4949 (a) A person commits an offense if the person violates this
5050 subchapter or a rule adopted or order issued under this subchapter.
5151 SECTION 4. The change in law made by this Act applies only
5252 to a violation committed on or after the effective date of this Act.
5353 A violation committed before the effective date of this Act is
5454 governed by the law in effect on the date the violation was
5555 committed, and the former law is continued in effect for that
5656 purpose. For purposes of this section, a violation was committed
5757 before the effective date of this Act if any element of the
5858 violation occurred before that date.
5959 SECTION 5. This Act takes effect September 1, 2015.
