| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 70.01, Alcoholic Beverage Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | Sec. 70.01. AUTHORIZED ACTIVITIES. The holder of a retail | |
| 13 | 13 | dealer's on-premise late hours license may sell beer for | |
| 14 | 14 | consumption on the premises on Sunday between the hours of 1:00 a.m. | |
| 15 | 15 | and 2 a.m. and on any other day between the hours of 12 p.m. and 2 | |
| 16 | 16 | a.m. if the premises covered by the license are in an area where the | |
| 17 | 17 | sale of beer during those [the] hours is authorized under Section | |
| 18 | 18 | 105.05(c) or (d) [by this code]. | |
| 19 | 19 | SECTION 2. The amendment by this Act of Section 70.01, | |
| 20 | 20 | Alcoholic Beverage Code, is intended to clarify rather than change | |
| 21 | 21 | existing law. | |
| 22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2015. |
