| 7 | 7 | | relating to coverage for certain services relating to postpartum |

| 8 | 8 | | depression under the medical assistance program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.0249 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.0249. SERVICES RELATED TO POSTPARTUM DEPRESSION. |
|---|
| 13 | 13 | | (a) For purposes of this section, "postpartum depression" means a |
|---|
| 14 | 14 | | disorder with postpartum onset that is categorized as a mood |
|---|
| 15 | 15 | | disorder by the American Psychiatric Association in the Diagnostic |
|---|
| 16 | 16 | | and Statistical Manual of Mental Disorders, 5th Edition (DSM-5), or |
|---|
| 17 | 17 | | a subsequent edition adopted by rule by the executive commissioner |
|---|
| 18 | 18 | | of the Health and Human Services Commission. |
|---|
| 19 | 19 | | (b) The department shall provide to a woman who receives |
|---|
| 20 | 20 | | medical assistance benefits during a pregnancy screening and |
|---|
| 21 | 21 | | treatment for postpartum depression for the eight-month period |
|---|
| 22 | 22 | | after the date the woman gives birth. |
|---|
| 23 | 23 | | (c) The executive commissioner of the Health and Human |
|---|
| 24 | 24 | | Services Commission shall adopt rules necessary to implement this |
|---|
| 25 | 25 | | section. |
|---|
| 26 | 26 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 27 | 27 | | a state agency determines that a waiver or authorization from a |
|---|
| 28 | 28 | | federal agency is necessary for implementation of that provision, |
|---|
| 29 | 29 | | the agency affected by the provision shall request the waiver or |
|---|
| 30 | 30 | | authorization and may delay implementing that provision until the |
|---|
| 31 | 31 | | waiver or authorization is granted. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2015. |
|---|
