15 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 8 | | SECTION 1. Subchapter B, Chapter 205, Labor Code, is |
---|
17 | 9 | | amended by adding Section 205.0125 to read as follows: |
---|
18 | 10 | | Sec. 205.0125. EXCEPTION FROM DUTY TO PAY REIMBURSEMENT. |
---|
19 | 11 | | (a) Notwithstanding any other provision of this chapter, a |
---|
20 | 12 | | reimbursing employer is not liable for paying a reimbursement for |
---|
21 | 13 | | benefits paid to an individual, regardless of whether the employer |
---|
22 | 14 | | was named as the individual's last work, if the individual's |
---|
23 | 15 | | separation from work with the employer resulted from the |
---|
24 | 16 | | individual: |
---|
25 | 17 | | (1) being discharged for misconduct; or |
---|
26 | 18 | | (2) voluntarily leaving work without good cause |
---|
27 | 19 | | connected with the individual's work. |
---|
28 | 20 | | (b) A reimbursing employer may contest reimbursements |
---|
29 | 21 | | billed to the employer by the commission in violation of this |
---|
30 | 22 | | section using the dispute resolution procedures prescribed by |
---|
31 | 23 | | Chapter 212 and rules adopted under that chapter. |
---|
32 | 24 | | SECTION 2. The change in law made by this Act applies only |
---|
33 | 25 | | to a claim for unemployment compensation benefits filed with the |
---|
34 | 26 | | Texas Workforce Commission on or after the effective date of this |
---|
35 | 27 | | Act. A claim filed before the effective date of this Act is |
---|
36 | 28 | | governed by the law in effect on the date the claim was filed, and |
---|
37 | 29 | | the former law is continued in effect for that purpose. |
---|
38 | 30 | | SECTION 3. This Act takes effect September 1, 2015. |
