225 relating to information regarding Down syndrome.
236 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
247 SECTION 1. Chapter 161, Health and Safety Code, is amended
258 by adding Subchapter W to read as follows:
269 SUBCHAPTER W. INFORMATION REGARDING DOWN SYNDROME
2710 Sec. 161.651. DEFINITIONS. In this subchapter:
2811 (1) "Down syndrome" means a chromosomal condition
2912 caused by the presence of an extra whole or partial copy of
3013 chromosome 21.
3114 (2) "Health care provider" has the meaning assigned by
3215 Section 34.001 and includes a genetic counselor.
3316 Sec. 161.652. INFORMATION REGARDING DOWN SYNDROME. (a)
3417 The department shall make available information regarding Down
3518 syndrome that includes:
3619 (1) information addressing physical, developmental,
3720 educational, and psychosocial outcomes, life expectancy, clinical
3821 course, and intellectual and functional development for
3922 individuals with Down syndrome;
4023 (2) information regarding available treatment options
4124 for individuals with Down syndrome;
4225 (3) contact information for national and local Down
4326 syndrome education and support programs, services, and
4427 organizations, including organizations in Houston, Dallas, San
4528 Antonio, and Austin, and information hotlines, resource centers,
4629 and clearinghouses; and
4730 (4) any other information required by the department.
4831 (b) The information described by Subsection (a) must be:
4932 (1) current, evidence-based information that:
5033 (A) has been reviewed by medical experts and
5134 local Down syndrome organizations; and
5235 (B) does not explicitly or implicitly present
5336 pregnancy termination as an option when a prenatal test indicates
5437 that the unborn child has Down syndrome; and
5538 (2) published in English and Spanish.
5639 (c) The department shall make the information described by
5740 Subsection (a) available on the department's Internet website in a
5841 format that may be easily printed. The department may provide the
5942 information described by Subsection (a) in writing to health care
6043 providers if the department determines that providing written
6144 information is cost-effective.
6245 Sec. 161.653. DUTY OF HEALTH CARE PROVIDER. (a) A health
6346 care provider who administers or causes to be administered a test
6447 for Down syndrome or who initially diagnoses a child with Down
6548 syndrome shall provide the information described by Section 161.652
6649 to:
6750 (1) expectant parents who receive a prenatal test
6851 result indicating a probability or diagnosis that the unborn child
6952 has Down syndrome; or
7053 (2) a parent of a child who receives:
7154 (A) a test result indicating a probability or
7255 diagnosis that the child has Down syndrome; or
7356 (B) a diagnosis of Down syndrome.
7457 (b) In addition to providing the information described by
7558 Subsection (a), a health care provider may provide additional
7659 information about Down syndrome that is current and evidence-based
7760 and has been reviewed by medical experts and national Down syndrome
7861 organizations.
7962 (c) Notwithstanding any other law, this section does not
8063 impose a standard of care or create an obligation or duty that
8164 provides a basis for a cause of action against a health care
8265 provider. A health care provider may not be held civilly or
8366 criminally liable for failing to provide information as required by
8467 Subsection (a).
8568 SECTION 2. This Act takes effect September 1, 2015.
