88 AN ACT
99 relating to increasing the fee on conviction paid by a defendant for
1010 a peace officer committing or releasing the defendant.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 102.011(a), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (a) A defendant convicted of a felony or a misdemeanor shall
1515 pay the following fees for services performed in the case by a peace
1616 officer:
1717 (1) $5 for issuing a written notice to appear in court
1818 following the defendant's violation of a traffic law, municipal
1919 ordinance, or penal law of this state, or for making an arrest
2020 without a warrant;
2121 (2) $50 for executing or processing an issued arrest
2222 warrant, capias, or capias pro fine with the fee imposed for the
2323 services of:
2424 (A) the law enforcement agency that executed the
2525 arrest warrant or capias, if the agency requests of the court, not
2626 later than the 15th day after the date of the execution of the
2727 arrest warrant or capias, the imposition of the fee on conviction;
2828 or
2929 (B) the law enforcement agency that processed the
3030 arrest warrant or capias, if:
3131 (i) the arrest warrant or capias was not
3232 executed; or
3333 (ii) the executing law enforcement agency
3434 failed to request the fee within the period required by Paragraph
3535 (A) of this subdivision;
3636 (3) $5 for summoning a witness;
3737 (4) $35 for serving a writ not otherwise listed in this
3838 article;
3939 (5) $10 for taking and approving a bond and, if
4040 necessary, returning the bond to the courthouse;
4141 (6) $25 [$5] for commitment or release;
4242 (7) $5 for summoning a jury, if a jury is summoned; and
4343 (8) $8 for each day's attendance of a prisoner in a
4444 habeas corpus case if the prisoner has been remanded to custody or
4545 held to bail.
4646 SECTION 2. Section 102.021, Government Code, is amended to
4747 read as follows:
4848 Sec. 102.021. COURT COSTS ON CONVICTION: CODE OF CRIMINAL
4949 PROCEDURE. A person convicted of an offense shall pay the
5050 following under the Code of Criminal Procedure, in addition to all
5151 other costs:
5252 (1) court cost on conviction of any offense, other
5353 than a conviction of an offense relating to a pedestrian or the
5454 parking of a motor vehicle (Art. 102.0045, Code of Criminal
5555 Procedure) . . . $4;
5656 (2) a fee for services of prosecutor (Art. 102.008,
5757 Code of Criminal Procedure) . . . $25;
5858 (3) fees for services of peace officer:
5959 (A) issuing a written notice to appear in court
6060 for certain violations (Art. 102.011, Code of Criminal Procedure)

130130 SECTION 3. The change in law made by this Act applies only
131131 to a fee imposed for the commitment or release of a defendant
132132 convicted of an offense committed on or after the effective date of
133133 this Act. A fee imposed for the commitment or release of a
134134 defendant convicted of an offense committed before the effective
135135 date of this Act is governed by the law in effect on the date the
136136 offense was committed, and the former law is continued in effect for
137137 that purpose. For purposes of this section, an offense was
138138 committed before the effective date of this Act if any element of
139139 the offense occurred before that date.
140140 SECTION 4. This Act takes effect September 1, 2015.
