| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 161, Utilities Code, is | |
| 11 | 11 | amended by adding Section 161.0721 to read as follows: | |
| 12 | 12 | Sec. 161.0721. ELECTION OF DIRECTORS IN CERTAIN LARGE | |
| 13 | 13 | COOPERATIVES. (a) This section applies only to an electric | |
| 14 | 14 | cooperative with more than 200,000 members that is partially | |
| 15 | 15 | located in a county with a population of more than one million and | |
| 16 | 16 | less than 1.5 million. | |
| 17 | 17 | (b) To be elected as director for a district, a candidate | |
| 18 | 18 | must receive a majority of the total number of votes received for | |
| 19 | 19 | that office. | |
| 20 | 20 | (c) If no candidate for director of a particular district | |
| 21 | 21 | receives the vote necessary to be elected, a runoff election for | |
| 22 | 22 | that office is required. | |
| 23 | 23 | SECTION 2. The changes in law made by Section 161.0721, | |
| 24 | 24 | Utilities Code, as added by this Act, apply only to an election held | |
| 25 | 25 | on or after the effective date of this Act. An election held before | |
| 26 | 26 | the effective date of this Act is subject to the law in effect on the | |
| 27 | 27 | date the election is held, and that law is continued in effect for | |
| 28 | 28 | that purpose. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2015. |
