| 11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 10 | | SECTION 1. Section 253.031, Election Code, is amended by |
|---|
| 13 | 11 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 14 | 12 | | follows: |
|---|
| 15 | 13 | | (a) Except as provided by Subsection (a-1), a [A] candidate |
|---|
| 16 | 14 | | may not knowingly accept a campaign contribution or make or |
|---|
| 17 | 15 | | authorize a campaign expenditure at a time when a campaign |
|---|
| 18 | 16 | | treasurer appointment for the candidate is not in effect. |
|---|
| 19 | 17 | | (a-1) A candidate may authorize a campaign expenditure made |
|---|
| 20 | 18 | | for the payment of a filing fee in connection with the candidate's |
|---|
| 21 | 19 | | application for a place on the ballot at a time when a campaign |
|---|
| 22 | 20 | | treasurer appointment for the candidate is not in effect. A |
|---|
| 23 | 21 | | candidate must report an expenditure described by this subsection |
|---|
| 24 | 22 | | on the first report required to be filed by the candidate under |
|---|
| 25 | 23 | | Chapter 254. |
|---|
| 26 | 24 | | SECTION 2. Section 253.031(a-1), Election Code, as added by |
|---|
| 27 | 25 | | this Act, applies only to the payment of a filing fee in connection |
|---|
| 28 | 26 | | with the candidate's application for a place on the ballot made on |
|---|
| 29 | 27 | | or after the effective date of this Act. The payment of a filing fee |
|---|
| 30 | 28 | | before the effective date of this Act is governed by the law in |
|---|
| 31 | 29 | | effect when the payment was made, and the former law is continued in |
|---|
| 32 | 30 | | effect for that purpose. |
|---|
| 33 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 35 | | Act takes effect September 1, 2015. |
