97 relating to the requirement that a candidate appoint a campaign
108 treasurer before making certain expenditures.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 253.031, Election Code, is amended by
1311 amending Subsection (a) and adding Subsection (a-1) to read as
1412 follows:
1513 (a) Except as provided by Subsection (a-1), a [A] candidate
1614 may not knowingly accept a campaign contribution or make or
1715 authorize a campaign expenditure at a time when a campaign
1816 treasurer appointment for the candidate is not in effect.
1917 (a-1) A candidate may authorize a campaign expenditure made
2018 for the payment of a filing fee in connection with the candidate's
2119 application for a place on the ballot at a time when a campaign
2220 treasurer appointment for the candidate is not in effect. A
2321 candidate must report an expenditure described by this subsection
2422 on the first report required to be filed by the candidate under
2523 Chapter 254.
2624 SECTION 2. Section 253.031(a-1), Election Code, as added by
2725 this Act, applies only to the payment of a filing fee in connection
2826 with the candidate's application for a place on the ballot made on
2927 or after the effective date of this Act. The payment of a filing fee
3028 before the effective date of this Act is governed by the law in
3129 effect when the payment was made, and the former law is continued in
3230 effect for that purpose.
3331 SECTION 3. This Act takes effect immediately if it receives
3432 a vote of two-thirds of all the members elected to each house, as
3533 provided by Section 39, Article III, Texas Constitution. If this
3634 Act does not receive the vote necessary for immediate effect, this
3735 Act takes effect September 1, 2015.
