| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 8503, Special District Local Laws Code, | |
| 11 | 11 | is amended by adding Section 8503.032 to read as follows: | |
| 12 | 12 | Sec. 8503.032. WATER INTAKE REQUIREMENTS. The authority | |
| 13 | 13 | shall include in its water management plan a requirement that a | |
| 14 | 14 | water intake that provides water for a municipality must be located | |
| 15 | 15 | at or below the lowest water level recorded during the drought of | |
| 16 | 16 | record for the reservoir in which the intake is located. | |
| 17 | 17 | SECTION 2. The changes in law made by this Act apply only to | |
| 18 | 18 | construction of a water intake structure that commences on or after | |
| 19 | 19 | the effective date of this Act. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2015. |
