| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 7212, Special District |
|---|
| 13 | 13 | | Local Laws Code, is amended by adding Section 7212.103 to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | Sec. 7212.103. LIMIT ON EMINENT DOMAIN POWER. The district |
|---|
| 16 | 16 | | may not exercise the power of eminent domain to condemn property |
|---|
| 17 | 17 | | located outside the boundaries or service area of the district |
|---|
| 18 | 18 | | unless the district exercises that power for a project the district |
|---|
| 19 | 19 | | owns and operates. |

| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2015. |
