55 AN ACT
66 relating to authority of an electric utility customer to choose not
77 to have an advanced meter; adding provisions subject to a criminal
88 penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 38, Utilities Code, is amended by adding
1111 Subchapter F to read as follows:
1212 SUBCHAPTER F. CONSUMER PROTECTIONS
1313 Sec. 38.151. RIGHT TO DECLINE OR REMOVE RADIO-EMITTING
1414 ADVANCED METER. (a) An electric utility by mail shall send to each
1515 retail electric service customer scheduled to receive an advanced
1616 meter that emits radio waves a notice to inform the customer that
1717 the customer may decline to have the meter installed and of the
1818 manner in which the customer may decline the installation. The
1919 notice may be included in a customer's monthly bill. The notice must
2020 provide a period of at least 30 days after the date the customer is
2121 expected to receive the notice during which the customer may notify
2222 the electric utility of the customer's choice to decline the
2323 installation of the meter.
2424 (b) If a retail electric service customer notifies the
2525 electric utility that the customer declines to have the advanced
2626 meter installed during the period stated in the notice, the
2727 electric utility:
2828 (1) may not install the meter;
2929 (2) may not charge the customer for declining
3030 installation; and
3131 (3) may not charge the customer for costs associated
3232 with traditional metering services.
3333 (c) An electric utility that has deployed advanced meters
3434 that emit radio waves shall include in the monthly bill for each
3535 retail electric service customer that is using an installed
3636 advanced meter of that type a notice to inform the customer that the
3737 customer may request to have the meter removed and replaced with a
3838 conventional meter and of the manner in which the customer may
3939 request the removal and replacement.
4040 (d) If a retail electric service customer or the owner of
4141 property where an advanced meter that emits radio waves is
4242 installed for retail electric service requests to have the meter
4343 removed, the electric utility:
4444 (1) shall promptly remove the advanced meter and
4545 replace it with a conventional meter;
4646 (2) may not charge the customer or property owner for
4747 removing or replacing the meter; and
4848 (3) may not charge the customer or property owner
4949 costs associated with traditional metering services.
5050 SECTION 2. Section 39.107, Utilities Code, is amended by
5151 adding Subsections (l), (m), (n), and (o) to read as follows:
5252 (l) An electric utility by mail shall send to each retail
5353 electric service customer scheduled to receive an advanced meter
5454 that emits radio waves a notice to inform the customer that the
5555 customer may decline to have the meter installed and of the manner
5656 in which the customer may decline the installation. The notice may
5757 be included in a customer's monthly bill. The notice must provide a
5858 period of at least 30 days after the date the customer is expected
5959 to receive the notice during which the customer may notify the
6060 electric utility of the customer's choice to decline the
6161 installation of the meter.
6262 (m) If a retail electric service customer notifies the
6363 electric utility that the customer declines to have the advanced
6464 meter installed during the period stated in the notice, the
6565 electric utility:
6666 (1) may not install the meter;
6767 (2) may not charge the customer for declining
6868 installation or the nonbypassable surcharge otherwise au
6969 thorized
7070 by Subsection (h); and
7171 (3) may not charge the customer for costs associated
7272 with traditional metering services.
7373 (n) An electric utility that has deployed advanced meters
7474 that emit radio waves shall include in the monthly bill for each
7575 retail electric service customer that is using an installed
7676 advanced meter of that type a notice to inform the customer that the
7777 customer may request to have the meter removed and replaced with a
7878 conventional meter and of the manner in which the customer may
7979 request the removal and replacement.
8080 (o) If a retail electric service customer or the owner of
8181 property where an advanced meter that emits radio waves is
8282 installed for retail electric service requests to have the meter
8383 removed, the electric utility:
8484 (1) shall promptly remove the advanced meter and
8585 replace it with a conventional meter;
8686 (2) may not charge the customer or property owner for
8787 removing or replacing the meter;
8888 (3) may not charge the customer the nonbypassable
8989 surcharge otherwise authorized by Subsection (h); and
9090 (4) may not charge the customer or property owner
9191 costs associated with traditional metering services.
9292 SECTION 3. This Act takes effect September 1, 2015.
