66 AN ACT
77 relating to the imposition and use of the admission fee to sexually
88 oriented businesses; increasing the amount of a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.052(a), Business & Commerce Code, is
1111 amended to read as follows:
1212 (a) A fee is imposed on a sexually oriented business in an
1313 amount equal to $8 [$5] for each entry by each customer admitted to
1414 the business.
1515 SECTION 2. Section 102.054, Business & Commerce Code, is
1616 amended to read as follows:
1717 Sec. 102.054. ALLOCATION OF CERTAIN REVENUE FOR SEXUAL
1818 ASSAULT PROGRAMS. The comptroller shall deposit five-eighths of
1919 the amount [the first $25 million] received from the fee imposed
2020 under this subchapter [in a state fiscal biennium] to the credit of
2121 the sexual assault program fund, up to a maximum of $25 million each
2222 state fiscal biennium.
2323 SECTION 3. Subchapter B, Chapter 102, Business & Commerce
2424 Code, is amended by adding Section 102.0555 to read as follows:
2525 Sec. 102.0555. ALLOCATION OF CERTAIN REVENUE FOR HUMAN
2626 TRAFFICKING ENFORCEMENT GRANTS. (a) The comptroller shall deposit
2727 three-eighths of the amount received from the fee imposed under
2828 this subchapter to the credit of the human trafficking prevention
2929 account, which is a dedicated account in the general revenue fund
3030 that may be appropriated only to the criminal justice division of
3131 the governor's office for the purpose of awarding grants under this
3232 section. The governor's office administers the account.
3333 (b) Using money received under this section, the criminal
3434 justice division of the governor's office shall award grants to
3535 district attorneys for the purpose of prosecuting human trafficking
3636 cases.
3737 (c) The criminal justice division of the governor's office
3838 shall adopt rules to administer the grant program under this
3939 section.
4040 SECTION 4. Section 102.055, Business & Commerce Code, is
4141 repealed.
4242 SECTION 5. This Act takes effect September 1, 2015.
