9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 102.052(a), Business & Commerce Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) A fee is imposed on a sexually oriented business in an |
---|
13 | 13 | | amount equal to $8 [$5] for each entry by each customer admitted to |
---|
14 | 14 | | the business. |
---|
15 | 15 | | SECTION 2. Section 102.054, Business & Commerce Code, is |
---|
16 | 16 | | amended to read as follows: |
---|
17 | 17 | | Sec. 102.054. ALLOCATION OF CERTAIN REVENUE FOR SEXUAL |
---|
18 | 18 | | ASSAULT PROGRAMS. The comptroller shall deposit five-eighths of |
---|
19 | 19 | | the amount [the first $25 million] received from the fee imposed |
---|
20 | 20 | | under this subchapter [in a state fiscal biennium] to the credit of |
---|
21 | 21 | | the sexual assault program fund, up to a maximum of $25 million each |
---|
22 | 22 | | state fiscal biennium. |

23 | 23 | | SECTION 3. Subchapter B, Chapter 102, Business & Commerce |
---|
24 | 24 | | Code, is amended by adding Section 102.0555 to read as follows: |

25 | 25 | | Sec. 102.0555. ALLOCATION OF CERTAIN REVENUE FOR HUMAN |
---|
26 | 26 | | TRAFFICKING ENFORCEMENT GRANTS. (a) The comptroller shall deposit |
---|
27 | 27 | | three-eighths of the amount received from the fee imposed under |
---|
28 | 28 | | this subchapter to the credit of the human trafficking prevention |
---|
29 | 29 | | account, which is a dedicated account in the general revenue fund |
---|
30 | 30 | | that may be appropriated only to the criminal justice division of |
---|
31 | 31 | | the governor's office for the purpose of awarding grants under this |
---|
32 | 32 | | section. The governor's office administers the account. |
---|
33 | 33 | | (b) Using money received under this section, the criminal |
---|
34 | 34 | | justice division of the governor's office shall award grants to |
---|
35 | 35 | | district attorneys for the purpose of prosecuting human trafficking |
---|
36 | 36 | | cases. |
---|
37 | 37 | | (c) The criminal justice division of the governor's office |
---|
38 | 38 | | shall adopt rules to administer the grant program under this |
---|
39 | 39 | | section. |
---|
40 | 40 | | SECTION 4. Section 102.055, Business & Commerce Code, is |
---|
41 | 41 | | repealed. |
---|
42 | 42 | | SECTION 5. This Act takes effect September 1, 2015. |
