55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eligibility of certain rural companies for support from
88 the universal service fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 56.021, Utilities Code, is amended to
1111 read as follows:
1212 Sec. 56.021. UNIVERSAL SERVICE FUND ESTABLISHED. The
1313 commission shall adopt and enforce rules requiring local exchange
1414 companies to establish a universal service fund to:
1515 (1) assist telecommunications providers in providing
1616 basic local telecommunications service at reasonable rates in high
1717 cost rural areas under two plans:
1818 (A) the Texas High Cost Universal Service Plan
1919 (16 T.A.C. Section 26.403); and
2020 (B) the Small and Rural Incumbent Local Exchange
2121 Company Universal Service Plan (16 T.A.C. Section 26.404);
2222 (2) reimburse the telecommunications carrier that
2323 provides the statewide telecommunications relay access service
2424 under Subchapter D;
2525 (3) finance the specialized telecommunications
2626 assistance program established under Subchapter E;
2727 (4) reimburse the department and the commission for
2828 costs incurred in implementing this chapter and Chapter 57;
2929 (5) reimburse a telecommunications carrier providing
3030 lifeline service as provided by 47 C.F.R. Part 54, Subpart E, as
3131 amended;
3232 (6) finance the implementation and administration of
3333 an integrated eligibility process created under Section 17.007 for
3434 customer service discounts relating to telecommunications
3535 services, including outreach expenses the commission determines
3636 are reasonable and necessary;
3737 (7) reimburse a designated provider under Subchapter
3838 F;
3939 (8) reimburse a successor utility under Subchapter G;
4040 [and]
4141 (9) finance the program established under Subchapter
4242 H; and
4343 (10) finance the rural basic and broadband service
4444 program established under Subchapter I.
4545 SECTION 2. Chapter 56, Utilities Code, is amended by adding
4646 Subchapter I to read as follows:
4747 SUBCHAPTER I. RURAL BASIC AND BROADBAND SERVICE PROGRAM
4848 Sec. 56.351. SUPPORT FOR BASIC AND BROADBAND SERVICES IN
4949 RURAL AREAS. (a) The commission shall provide from the universal
5050 service fund financial assistance for a telecommunications
5151 provider that holds a certificate of operating authority or a
5252 service provider certificate of operating authority to build and
5353 maintain facility-based networks capable of providing access to
5454 basic local telecommunications service and broadband service in
5555 rural areas of this state where:
5656 (1) an incumbent local exchange company no longer
5757 seeks support for a particular exchange; and
5858 (2) support is necessary to allow the provision of
5959 services at rates comparable to the benchmark rates established by
6060 the Federal Communications Commission.
6161 (b) Support received under this subchapter may not be used
6262 for a purpose other than a purpose described by Subsection (a).
6363 (c) In an area where an incumbent local exchange company
6464 provides service and seeks support from the universal service fund,
6565 telecommunications providers eligible to receive support under
6666 this subchapter will continue to receive per-line support identical
6767 to the support received by the incumbent local exchange company.
6868 Sec. 56.352. NETWORK STANDARDS. The commission by rule
6969 shall establish standards for networks built or maintained using
7070 support disbursed under this subchapter. The standards must require
7171 a network to provide basic local telecommunications service and
7272 broadband service and be consistent with standards established by
7373 the federal government.
7474 Sec. 56.353. SUPPORT LEVEL. (a) The commission shall adopt
7575 rules to ensure that support provided under this subchapter is
7676 calculated in a manner that is consistent with standard accounting
7777 principles.
7878 (b) Until the commission determines the level of support
7979 necessary to allow a telecommunications provider eligible to
8080 receive support under this subchapter to fulfill the requirements
8181 of this subchapter:
8282 (1) on or before September 1, 2017, the provider is
8383 entitled to receive at least the level of support the provider is
8484 entitled to receive on the date the provider requests support from
8585 the commission; and
8686 (2) after September 1, 2017, the provider is entitled
8787 to receive at least the level of support the provider is entitled to
8888 receive under commission rules effective on September 1, 2017.
8989 SECTION 3. This Act takes effect September 1, 2015.
