55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to use of the money from the Texas Enterprise Fund and the
88 Texas emerging technology fund to benefit certain historically
99 underutilized businesses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 481.078, Government Code, is amended by
1212 adding Subsections (n) and (o) to read as follows:
1313 (n) To encourage the development and location of
1414 historically underutilized businesses in this state, the governor
1515 shall consider making grants from the fund:
1616 (1) to recipients that are historically underutilized
1717 businesses in this state that commit to using the grants to create
1818 additional jobs; or
1919 (2) to recipients that are historically underutilized
2020 businesses from outside the state that commit to relocate to this
2121 state.
2222 (o) For purposes of this section:
2323 (1) "Historically underutilized business" means:
2424 (A) a corporation formed for the purpose of
2525 making a profit in which 51 percent or more of all classes of the
2626 shares of stock or other equitable securities are owned by one or
2727 more economically disadvantaged persons who have a proportionate
2828 interest and actively participate in the corporation's control,
2929 operation, and management;
3030 (B) a sole proprietorship created for the purpose
3131 of making a profit that is completely owned, operated, and
3232 controlled by an economically disadvantaged person;
3333 (C) a partnership formed for the purpose of
3434 making a profit in which 51 percent or more of the assets and
3535 interest in the partnership are owned by one or more economically
3636 disadvantaged persons who have a proportionate interest and
3737 actively participate in the partnership's control, operation, and
3838 management; or
3939 (D) a joint venture in which each entity in the
4040 venture is a historically underutilized business, as determined
4141 under another paragraph of this subdivision.
4242 (2) "Economically disadvantaged person" has the
4343 meaning assigned by Section 2161.001.
4444 SECTION 2. Section 481.079(a), Government Code, is amended
4545 to read as follows:
4646 (a) Before the beginning of each regular session of the
4747 legislature, the governor shall submit to the lieutenant governor,
4848 the speaker of the house of representatives, and each other member
4949 of the legislature a report on grants made under Section 481.078
5050 that states:
5151 (1) the number of direct jobs each recipient committed
5252 to create in this state;
5353 (2) the number of direct jobs each recipient created
5454 in this state;
5555 (3) the median wage of the jobs each recipient created
5656 in this state;
5757 (4) the amount of capital investment each recipient
5858 committed to expend or allocate per project in this state;
5959 (5) the amount of capital investment each recipient
6060 expended or allocated per project in this state;
6161 (6) the total amount of grants made to each recipient;
6262 (7) the average amount of money granted in this state
6363 for each job created in this state by grant recipients;
6464 (8) the number of jobs created in this state by grant
6565 recipients in each sector of the North American Industry
6666 Classification System (NAICS); [and]
6767 (9) of the number of direct jobs each recipient
6868 created in this state, the number of positions created that provide
6969 health benefits for employees; and
7070 (10) the total number of grant recipients that are
7171 historically underutilized businesses and the total amount of
7272 grants made to those recipients.
7373 SECTION 3. Section 490.101, Government Code, is amended by
7474 adding Subsections (j) and (k) to read as follows:
7575 (j) To encourage the development and location of
7676 historically underutilized businesses in this state, the governor
7777 shall consider making awards from the fund:
7878 (1) to recipients that are historically underutilized
7979 businesses in this state that commit to using the awards to create
8080 additional jobs; or
8181 (2) to recipients that are historically underutilized
8282 businesses from outside the state that commit to relocate to this
8383 state.
8484 (k) For purposes of this section:
8585 (1) "Historically underutilized business" means:
8686 (A) a corporation formed for the purpose of
8787 making a profit in which 51 percent or more of all classes of the
8888 shares of stock or other equitable securities are owned by one or
8989 more economically disadvantaged persons who have a proportionate
9090 interest and actively participate in the corporation's control,
9191 operation, and management;
9292 (B) a sole proprietorship created for the purpose
9393 of making a profit that is completely owned, operated, and
9494 controlled by an economically disadvantaged person;
9595 (C) a partnership formed for the purpose of
9696 making a profit in which 51 percent or more of the assets and
9797 interest in the partnership are owned by one or more economically
9898 disadvantaged persons who have a proportionate interest and
9999 actively participate in the partnership's control, operation, and
100100 management; or
101101 (D) a joint venture in which each entity in the
102102 venture is a historically underutilized business, as determined
103103 under another paragraph of this subdivision.
104104 (2) "Economically disadvantaged person" has the
105105 meaning assigned by Section 2161.001.
106106 SECTION 4. Section 490.005(b), Government Code, is amended
107107 to read as follows:
108108 (b) The annual report must also contain:
109109 (1) the total number of jobs actually created by each
110110 project receiving funding under this chapter;
111111 (2) an analysis of the number of jobs actually created
112112 by each project receiving funding under this chapter; [and]
113113 (3) a brief description regarding:
114114 (A) the methodology used to determine the
115115 information provided under Subdivisions (1) and (2), which may be
116116 developed in consultation with the comptroller's office;
117117 (B) the intended outcomes of projects funded
118118 under Subchapter D during each preceding state fiscal year; and
119119 (C) the actual outcomes of all projects funded
120120 under Subchapter D during each preceding state fiscal year,
121121 including any financial impact on the state resulting from a
122122 liquidity event involving a company whose project was funded under
123123 that subchapter; and
124124 (4) the total number of recipients of awards from the
125125 fund that are historically underutilized businesses and the total
126126 amount of awards made to those recipients.
127127 SECTION 5. This Act takes effect immediately if it receives
128128 a vote of two-thirds of all the members elected to each house, as
129129 provided by Section 39, Article III, Texas Constitution. If this
130130 Act does not receive the vote necessary for immediate effect, this
131131 Act takes effect September 1, 2015.
