66 AN ACT
77 relating to the certification of structural engineers; providing
88 for a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1001, Occupations Code, is amended by
1111 adding Subchapter H-1 to read as follows:
1212 SUBCHAPTER H-1. CERTIFICATION OF STRUCTURAL ENGINEERS
1313 Sec. 1001.371. DEFINITIONS. In this subchapter:
1414 (1) "Significant structure" means a building or
1515 structure assigned to Occupancy Category III or IV under Table
1616 1604.5 of the 2009 edition of the International Building Code.
1717 (2) "Structural engineer" means a person licensed to
1818 engage in the practice of engineering and certified to practice
1919 structural engineering in this state.
2020 (3) "Structural engineering" means a specialized
2121 branch of professional engineering involving the practice of
2222 structural engineering of significant structures.
2323 Sec. 1001.372. CERTIFICATE REQUIRED. (a) A person may not
2424 engage in the practice of structural engineering unless the person
2525 holds a structural engineer certificate issued under this
2626 subchapter.
2727 (b) A person may not, unless the person holds a structural
2828 engineer certificate issued under this subchapter, directly or
2929 indirectly use or cause to be used as a professional, business, or
3030 commercial identification, title, name, representation, claim,
3131 asset, or means of advantage or benefit any of, or a variation or
3232 abbreviation of, the following terms:
3333 (1) "structural engineer";
3434 (2) "professional structural engineer";
3535 (3) "licensed structural engineer"; or
3636 (4) "certified structural engineer."
3737 Sec. 1001.373. CERTIFICATION REQUIREMENTS. To qualify for
3838 a structural engineer certificate, an applicant must:
3939 (1) be licensed under this chapter as an engineer; and
4040 (2) pass the structural engineering examination
4141 prescribed by the board.
4242 Sec. 1001.374. APPLICATION. The board by rule shall:
4343 (1) prescribe an application form for the issuance or
4444 renewal of a structural engineer certificate; and
4545 (2) determine the information to be included in the
4646 application.
4747 Sec. 1001.375. EXAMINATION. The board shall administer a
4848 16-hour examination to determine the qualifications of an applicant
4949 for a structural engineer certificate.
5050 Sec. 1001.376. CERTIFICATE. The board shall issue a
5151 structural engineer certificate to an applicant who meets the
5252 qualifications prescribed by the board by rule and pays the
5353 required fees.
5454 Sec. 1001.377. SEAL. (a) On receiving a structural
5555 engineer certificate, a certificate holder shall obtain a seal in a
5656 design authorized by the board, showing the certificate holder's
5757 name and the legend "Structural Engineer."
5858 (b) The seal may be used in lieu of a seal obtained under
5959 Section 1001.401.
6060 Sec. 1001.378. RENEWAL. (a) A certificate issued under
6161 this subchapter is valid for one year from the date of issuance.
6262 (b) The holder of a certificate may renew the certificate by
6363 paying a renewal fee and complying with other renewal requirements
6464 prescribed by board rule before the expiration date.
6565 Sec. 1001.379. FEES. The board shall establish and collect
6666 reasonable and necessary fees in amounts sufficient to cover the
6767 costs of administering this subchapter.
6868 SECTION 2. (a) Not later than May 1, 2016, the Texas Board
6969 of Professional Engineers shall:
7070 (1) establish the qualifications for issuance and
7171 renewal of a structural engineer certificate; and
7272 (2) adopt the rules necessary to implement the changes
7373 in law made by this Act.
7474 (b) A person is not required to obtain a structural engineer
7575 certificate under Subchapter H-1, Chapter 1001, Occupations Code,
7676 as added by this Act, before September 1, 2016.
7777 SECTION 3. A person practicing as a licensed engineer in
7878 structural engineering on the effective date of this Act is
7979 entitled to issuance of a structural engineer certificate and to
8080 continue to practice structural engineering without fulfilling any
8181 additional education, training, or examination requirements
8282 established by the Texas Board of Professional Engineers under
8383 Subchapter H-1, Chapter 1001, Occupations Code, as added by this
8484 Act, if the person has the other qualifications required by the
8585 board and Chapter 1001 and if, before August 31, 2016, the person
8686 submits an application on a form prescribed by the board and an
8787 affidavit attesting to the person's experience as a structural
8888 engineer.
8989 SECTION 4. This Act takes effect September 1, 2015.
