66 AN ACT
77 relating to equal opportunity for access by home-schooled students
88 to University Interscholastic League sponsored activities;
99 authorizing a fee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.0832 to read as follows:
1313 Sec. 33.0832. EQUAL OPPORTUNITY FOR HOME-SCHOOLED STUDENTS
1414 TO PARTICIPATE IN UNIVERSITY INTERSCHOLASTIC LEAGUE ACTIVITIES.
1515 (a) Except as provided by Subsection (d), a public school that
1616 participates in an activity sponsored by the University
1717 Interscholastic League shall provide a home-schooled student who
1818 resides in the school's attendance area with the opportunity to
1919 participate in the activity on behalf of the school in the same
2020 manner that the school provides the opportunity to participate to
2121 students enrolled in the school.
2222 (b) A home-schooled student who seeks to participate or who
2323 participates in a league activity on behalf of a school is subject
2424 to the relevant policies that apply to students enrolled in the
2525 school, including policies regarding registration, age
2626 eligibility, fees, insurance, transportation, physical condition,
2727 qualifications, responsibilities, event schedules, standards of
2828 behavior, and performance.
2929 (c) As a condition of participation by a home-schooled
3030 student in a league activity under this section, the individual who
3131 primarily provides instruction to the student must submit a written
3232 verification to the school indicating whether the student is:
3333 (1) receiving a passing grade in each course or
3434 subject taught; and
3535 (2) maintaining satisfactory progress towards
3636 academic advancement or promotion.
3737 (d) A home-schooled student is not authorized by this
3838 section to participate in a league activity during the remainder of
3939 any school year during which the student was previously enrolled in
4040 a public school.
4141 (e) The University Interscholastic League may not prohibit
4242 a home-schooled student from participating in league activities in
4343 the manner authorized by this section.
4444 SECTION 2. This Act applies beginning with the 2015-2016
4545 school year.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2015.
