| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 33.0832 to read as follows: |
|---|
| 13 | 13 | | Sec. 33.0832. EQUAL OPPORTUNITY FOR HOME-SCHOOLED STUDENTS |
|---|
| 14 | 14 | | TO PARTICIPATE IN UNIVERSITY INTERSCHOLASTIC LEAGUE ACTIVITIES. |
|---|
| 15 | 15 | | (a) Except as provided by Subsection (d), a public school that |
|---|
| 16 | 16 | | participates in an activity sponsored by the University |
|---|
| 17 | 17 | | Interscholastic League shall provide a home-schooled student who |
|---|
| 18 | 18 | | resides in the school's attendance area with the opportunity to |
|---|
| 19 | 19 | | participate in the activity on behalf of the school in the same |
|---|
| 20 | 20 | | manner that the school provides the opportunity to participate to |
|---|
| 21 | 21 | | students enrolled in the school. |
|---|
| 22 | 22 | | (b) A home-schooled student who seeks to participate or who |
|---|
| 23 | 23 | | participates in a league activity on behalf of a school is subject |
|---|
| 24 | 24 | | to the relevant policies that apply to students enrolled in the |
|---|
| 25 | 25 | | school, including policies regarding registration, age |
|---|
| 26 | 26 | | eligibility, fees, insurance, transportation, physical condition, |
|---|
| 27 | 27 | | qualifications, responsibilities, event schedules, standards of |
|---|
| 28 | 28 | | behavior, and performance. |
|---|
| 29 | 29 | | (c) As a condition of participation by a home-schooled |
|---|
| 30 | 30 | | student in a league activity under this section, the individual who |
|---|
| 31 | 31 | | primarily provides instruction to the student must submit a written |
|---|
| 32 | 32 | | verification to the school indicating whether the student is: |
|---|
| 33 | 33 | | (1) receiving a passing grade in each course or |
|---|
| 34 | 34 | | subject taught; and |
|---|
| 35 | 35 | | (2) maintaining satisfactory progress towards |
|---|
| 36 | 36 | | academic advancement or promotion. |
|---|
| 37 | 37 | | (d) A home-schooled student is not authorized by this |
|---|
| 38 | 38 | | section to participate in a league activity during the remainder of |
|---|
| 39 | 39 | | any school year during which the student was previously enrolled in |
|---|
| 40 | 40 | | a public school. |
|---|
| 41 | 41 | | (e) The University Interscholastic League may not prohibit |
|---|
| 42 | 42 | | a home-schooled student from participating in league activities in |
|---|
| 43 | 43 | | the manner authorized by this section. |
|---|
| 44 | 44 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 45 | 45 | | school year. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2015. |
