66 AN ACT
77 relating to the provision of a cranial molding orthosis under the
88 medical assistance and child health plan programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 62, Health and Safety
1111 Code, is amended by adding Section 62.1511 to read as follows:
1212 Sec. 62.1511. CHILD HEALTH PLAN COVERAGE FOR CRANIAL
1313 MOLDING ORTHOSIS. (a) Subject to the requirements of this section,
1414 the child health plan must provide a cranial molding orthosis as a
1515 covered benefit for a child health plan enrollee who is at least 3
1616 months of age but younger than 18 months of age.
1717 (b) To qualify for coverage as a child health plan benefit,
1818 a cranial molding orthosis must be:
1919 (1) medically necessary, as established by
2020 demonstrating that the child health plan enrollee has a cranial
2121 vault asymmetry index of at least 6.25 or a cephalic index that is
2222 at least two standard deviations above or below the age-adjusted
2323 mean for the enrollee; and
2424 (2) used as part of:
2525 (A) a nonsurgical treatment program if the
2626 enrollee is diagnosed with plagiocephaly, brachycephaly, or
2727 scaphocephaly; or
2828 (B) a surgical treatment program if the cranial
2929 remolding orthosis is for postsurgical use to address additional
3030 cranial deformities, including craniosynostosis.
3131 SECTION 2. Section 32.024, Human Resources Code, is amended
3232 by adding Subsection (mm) to read as follows:
3333 (mm) Subject to the requirements of this subsection, the
3434 department shall provide medical assistance for a cranial molding
3535 orthosis for a child who is at least 3 months of age but younger than
3636 18 months of age. The cranial molding orthosis must be:
3737 (1) medically necessary, as established by
3838 demonstrating that the recipient has a cranial vault asymmetry
3939 index of at least 6.25 or a cephalic index that is at least two
4040 standard deviations above or below the age-adjusted mean for the
4141 recipient; and
4242 (2) used as part of:
4343 (A) a nonsurgical treatment program if the
4444 recipient is diagnosed with plagiocephaly, brachycephaly, or
4545 scaphocephaly; or
4646 (B) a surgical treatment program if the cranial
4747 remolding orthosis is for postsurgical use to address additional
4848 cranial deformities, including craniosynostosis.
4949 SECTION 3. If before implementing any provision of this Act
5050 a state agency determines that a waiver or authorization from a
5151 federal agency is necessary for implementation of that provision,
5252 the agency affected by the provision shall request the waiver or
5353 authorization and may delay implementing that provision until the
5454 waiver or authorization is granted.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2015.
