6	6	AN ACT
7	7	relating to the provision of a cranial molding orthosis under the
8	8	medical assistance and child health plan programs.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter D, Chapter 62, Health and Safety
11	11	Code, is amended by adding Section 62.1511 to read as follows:
12	12	Sec. 62.1511. CHILD HEALTH PLAN COVERAGE FOR CRANIAL
13	13	MOLDING ORTHOSIS. (a) Subject to the requirements of this section,
14	14	the child health plan must provide a cranial molding orthosis as a
15	15	covered benefit for a child health plan enrollee who is at least 3
16	16	months of age but younger than 18 months of age.
17	17	(b) To qualify for coverage as a child health plan benefit,
18	18	a cranial molding orthosis must be:
19	19	(1) medically necessary, as established by
20	20	demonstrating that the child health plan enrollee has a cranial
21	21	vault asymmetry index of at least 6.25 or a cephalic index that is
22	22	at least two standard deviations above or below the age-adjusted
23	23	mean for the enrollee; and
24	24	(2) used as part of:
25	25	(A) a nonsurgical treatment program if the
26	26	enrollee is diagnosed with plagiocephaly, brachycephaly, or
27	27	scaphocephaly; or
28	28	(B) a surgical treatment program if the cranial
29	29	remolding orthosis is for postsurgical use to address additional
30	30	cranial deformities, including craniosynostosis.
31	31	SECTION 2. Section 32.024, Human Resources Code, is amended
32	32	by adding Subsection (mm) to read as follows:
33	33	(mm) Subject to the requirements of this subsection, the
34	34	department shall provide medical assistance for a cranial molding
35	35	orthosis for a child who is at least 3 months of age but younger than
36	36	18 months of age. The cranial molding orthosis must be:
37	37	(1) medically necessary, as established by
38	38	demonstrating that the recipient has a cranial vault asymmetry
39	39	index of at least 6.25 or a cephalic index that is at least two
40	40	standard deviations above or below the age-adjusted mean for the
41	41	recipient; and
42	42	(2) used as part of:
43	43	(A) a nonsurgical treatment program if the
44	44	recipient is diagnosed with plagiocephaly, brachycephaly, or
45	45	scaphocephaly; or
46	46	(B) a surgical treatment program if the cranial
47	47	remolding orthosis is for postsurgical use to address additional
48	48	cranial deformities, including craniosynostosis.
49	49	SECTION 3. If before implementing any provision of this Act
50	50	a state agency determines that a waiver or authorization from a
51	51	federal agency is necessary for implementation of that provision,
52	52	the agency affected by the provision shall request the waiver or
53	53	authorization and may delay implementing that provision until the
54	54	waiver or authorization is granted.
55	55	SECTION 4. This Act takes effect immediately if it receives
56	56	a vote of two-thirds of all the members elected to each house, as
57	57	provided by Section 39, Article III, Texas Constitution. If this
58	58	Act does not receive the vote necessary for immediate effect, this
59	59	Act takes effect September 1, 2015.
