99 relating to health care information provided by and notice of
1010 facility fees charged by certain freestanding emergency medical
1111 care facilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 241, Health and Safety Code, is amended
1414 by adding Subchapter J to read as follows:
1515 SUBCHAPTER J. NOTICE OF FACILITY FEES IN CERTAIN FREESTANDING
1616 EMERGENCY MEDICAL CARE FACILITIES
1717 Sec. 241.251. APPLICABILITY. This subchapter applies only
1818 to a freestanding emergency medical care facility, as that term is
1919 defined by Section 254.001, that is exempt from the licensing
2020 requirements of Chapter 254 under Section 254.052(8).
2121 Sec. 241.252. NOTICE OF FEES. (a) In this section,
2222 "provider network" has the meaning assigned by Section 1456.001,
2323 Insurance Code.
2424 (b) A facility described by Section 241.251 shall post
2525 notice that states:
2626 (1) that the facility is a freestanding emergency
2727 medical care facility;
2828 (2) that the facility charges rates comparable to a
2929 hospital emergency room and may charge a facility fee;
3030 (3) that a facility or a physician providing medical
3131 care at the facility may not be a participating provider in the
3232 patient's health benefit plan provider network; and
3333 (4) that a physician providing medical care at the
3434 facility may bill separately from the facility for the medical care
3535 provided to a patient.
3636 (c) The notice required by this section must be posted
3737 prominently and conspicuously:
3838 (1) at the primary entrance to the facility;
3939 (2) in each patient treatment room; and
4040 (3) at each location within the facility at which a
4141 person pays for health care services.
4242 (d) The notice required by this section must be in legible
4343 print on a sign with dimensions of at least 8.5 inches by 11 inches.
4444 SECTION 2. Section 254.001, Health and Safety Code, is
4545 amended by adding Subdivision (6) to read as follows:
4646 (6) "Provider network" has the meaning assigned by
4747 Section 1456.001, Insurance Code.
4848 SECTION 3. Subchapter D, Chapter 254, Health and Safety
4949 Code, is amended by adding Section 254.155 to read as follows:
5050 Sec. 254.155. NOTICE OF FEES. (a) A facility shall post
5151 notice that states:
5252 (1) that the facility is a freestanding emergency
5353 medical care facility;
5454 (2) that the facility charges rates comparable to a
5555 hospital emergency room and may charge a facility fee;
5656 (3) that a facility or a physician providing medical
5757 care at the facility may not be a participating provider in the
5858 patient's health benefit plan provider network; and
5959 (4) that a physician providing medical care at the
6060 facility may bill separately from the facility for the medical care
6161 provided to a patient.
6262 (b) The notice required by this section must be posted
6363 prominently and conspicuously:
6464 (1) at the primary entrance to the facility;
6565 (2) in each patient treatment room; and
6666 (3) at each location within the facility at which a
6767 person pays for health care services.
6868 (c) The notice required by this section must be in legible
6969 print on a sign with dimensions of at least 8.5 inches by 11 inches.
7070 SECTION 4. Section 324.001(7), Health and Safety Code, is
7171 amended to read as follows:
7272 (7) "Facility" means:
7373 (A) an ambulatory surgical center licensed under
7474 Chapter 243;
7575 (B) a birthing center licensed under Chapter 244;
7676 [or]
7777 (C) a hospital licensed under Chapter 241; or
7878 (D) a freestanding emergency medical care
7979 facility, as defined in Section 254.001, including a freestanding
8080 emergency medical care facility that is exempt from the licensing
8181 requirements of Chapter 254 under Section 254.052(8).
8282 SECTION 5. Section 241.183, Health and Safety Code, as
8383 added by Chapter 917 (H.B. 1376), Acts of the 83rd Legislature,
8484 Regular Session, 2013, and as amended by S.B. No. 219, Acts of the
8585 84th Legislature, Regular Session, 2015, is repealed.
8686 SECTION 6. (a) Notwithstanding Subchapter J, Chapter 241,
8787 Health and Safety Code, and Section 254.155, Health and Safety
8888 Code, as added by this Act, a freestanding emergency medical care
8989 facility is not required to comply with those provisions until
9090 January 1, 2016.
9191 (b) Notwithstanding Chapter 324, Health and Safety Code, as
9292 amended by this Act, a freestanding emergency medical care facility
9393 is not required to comply with Chapter 324, Health and Safety Code,
9494 until January 1, 2016.
9595 SECTION 7. This Act takes effect September 1, 2015.
