| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 180, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 180.008 to read as follows: |
|---|
| 12 | 12 | | Sec. 180.008. EMERGENCY MEDICAL SERVICES PERSONNEL: APPEAL |
|---|
| 13 | 13 | | OF TERMINATION TO STATE OFFICE OF ADMINISTRATIVE HEARINGS. (a) In |
|---|
| 14 | 14 | | this section: |
|---|
| 15 | 15 | | (1) "Emergency medical services personnel" has the |
|---|
| 16 | 16 | | meaning assigned by Section 773.003, Health and Safety Code. |
|---|
| 17 | 17 | | (2) "Municipality" has the meaning assigned by Section |
|---|
| 18 | 18 | | 1.005, Texas Local Government Code. |
|---|
| 19 | 19 | | (b) This section only applies to a municipality and |
|---|
| 20 | 20 | | emergency medical services personnel covered by Subchapter K, |
|---|
| 21 | 21 | | Chapter 143 |
|---|
| 22 | 22 | | (c) Notwithstanding any other law, an individual who is |
|---|
| 23 | 23 | | certified to practice as emergency medical services personnel and |
|---|
| 24 | 24 | | who is employed by a municipality covered by Texas Local Government |
|---|
| 25 | 25 | | Code Chapter 143 is entitled to appeal the withdrawal of the |
|---|
| 26 | 26 | | individual's authority to provide delegated medical care and |
|---|
| 27 | 27 | | subsequent termination of |
|---|
| 28 | 28 | | employment as an emergency medical |
|---|
| 29 | 29 | | services personnel by the municipality to the State Office of |
|---|
| 30 | 30 | | Administrative Hearings. |
|---|
| 31 | 31 | | (d) A municipality shall adopt procedures for referring |
|---|
| 32 | 32 | | appeals described under Subsection (b) consistent with procedures |
|---|
| 33 | 33 | | used under Section 2003.021(b)(4), Government Code, and any |
|---|
| 34 | 34 | | applicable rules adopted by the State Office of Administrative |
|---|
| 35 | 35 | | Hearings. |
|---|
| 36 | 36 | | SECTION 3. Section 180.008, Local Government Code, as added |
|---|
| 37 | 37 | | by this Act, applies only to an appeal of the withdrawal of an |
|---|
| 38 | 38 | | individual's authority to provide delegated medical care and |
|---|
| 39 | 39 | | subsequent termination of employment as an emergency medical |
|---|
| 40 | 40 | | services personnel that occurs after the effective date of this |
|---|
| 41 | 41 | | Act. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2015. |
