99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 180, Local Government Code, is amended
1111 by adding Section 180.008 to read as follows:
1212 Sec. 180.008. EMERGENCY MEDICAL SERVICES PERSONNEL: APPEAL
1313 OF TERMINATION TO STATE OFFICE OF ADMINISTRATIVE HEARINGS. (a) In
1414 this section:
1515 (1) "Emergency medical services personnel" has the
1616 meaning assigned by Section 773.003, Health and Safety Code.
1717 (2) "Municipality" has the meaning assigned by Section
1818 1.005, Texas Local Government Code.
1919 (b) This section only applies to a municipality and
2020 emergency medical services personnel covered by Subchapter K,
2121 Chapter 143
2222 (c) Notwithstanding any other law, an individual who is
2323 certified to practice as emergency medical services personnel and
2424 who is employed by a municipality covered by Texas Local Government
2525 Code Chapter 143 is entitled to appeal the withdrawal of the
2626 individual's authority to provide delegated medical care and
2727 subsequent termination of
2828 employment as an emergency medical
2929 services personnel by the municipality to the State Office of
3030 Administrative Hearings.
3131 (d) A municipality shall adopt procedures for referring
3232 appeals described under Subsection (b) consistent with procedures
3333 used under Section 2003.021(b)(4), Government Code, and any
3434 applicable rules adopted by the State Office of Administrative
3535 Hearings.
3636 SECTION 3. Section 180.008, Local Government Code, as added
3737 by this Act, applies only to an appeal of the withdrawal of an
3838 individual's authority to provide delegated medical care and
3939 subsequent termination of employment as an emergency medical
4040 services personnel that occurs after the effective date of this
4141 Act.
4242 SECTION 4. This Act takes effect September 1, 2015.
