66 AN ACT
77 relating to unprofessional conduct by mental health providers who
88 attempt to change the sexual orientation of a child; providing
99 penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Chapter 105, Occupations Code, is
1212 amended to read as follows:
1313 CHAPTER 105. UNPROFESSIONAL CONDUCT BY CERTAIN PROVIDERS [HEALTH
1414 CARE PROVIDER]
1515 SECTION 2. Chapter 105, Occupations Code, is amended by
1616 designating Sections 105.001 and 105.002 as Subchapter A and adding
1717 a subchapter heading to read as follows:
1818 SUBCHAPTER A. UNPROFESSIONAL CONDUCT BY HEALTH CARE PROVIDER
1919 SECTION 3. Section 105.001, Occupations Code, is amended to
2020 read as follows:
2121 Sec. 105.001. DEFINITION. In this subchapter [chapter],
2222 "health care provider" means a person who furnishes services under
2323 a license, certificate, registration, or other authority issued by
2424 this state or another state to diagnose, prevent, alleviate, or
2525 cure a human illness or injury.
2626 SECTION 4. Chapter 105, Occupations Code, is amended by
2727 adding Subchapter B to read as follows:
2828 SUBCHAPTER B. UNPROFESSIONAL CONDUCT BY MENTAL HEALTH PROVIDER
2929 Sec. 105.051. DEFINITIONS. In this subchapter:
3030 (1) "Child" means an individual younger than 18 years
3131 of age.
3232 (2) "Gender identity or expression" means a person's
3333 having, or being perceived as having, a gender-related identity,
3434 appearance, expression, or behavior, whether or not that identity,
3535 appearance, expression, or behavior is different from that commonly
3636 associated with the person's assigned sex at birth.
3737 (3) "Mental health provider" means a:
3838 (A) chemical dependency counselor licensed under
3939 Chapter 504;
4040 (B) licensed professional counselor licensed
4141 under Chapter 503;
4242 (C) marriage and family therapist licensed under
4343 Chapter 502;
4444 (D) nurse licensed under Chapter 301;
4545 (E) physician licensed under Subtitle B;
4646 (F) psychologist licensed under Chapter 501;
4747 (G) sex offender treatment provider licensed
4848 under Chapter 110;
4949 (H) social worker licensed under Chapter 505;
5050 (I) special officer for offenders with mental
5151 impairments certified under Section 1701.404; or
5252 (J) another person licensed by this state to
5353 provide professional therapy or counseling services.
5454 (4) "Sexual orientation" means the actual or perceived
5555 status of an individual with respect to the individual's sexuality.
5656 Sec. 105.052. UNPROFESSIONAL CONDUCT. (a) A mental health
5757 provider engages in unprofessional conduct if, in the course of
5858 providing services to a child or minor, the mental health provider
5959 attempts to:
6060 (1) change the child's or minor's sexual orientation,
6161 including by attempting to change the child's or minor's behavior or
6262 gender identity or expression; or
6363 (2) eliminate or reduce the child's or minor's sexual
6464 or romantic attractions or feelings toward individuals of the same
6565 sex.
6666 (b) Subsection (a) does not apply to counseling that:
6767 (1) provides acceptance, support, and understanding
6868 of a child or minor or facilitates a child or minor's coping, social
6969 support, and identity exploration and development, including
7070 sexual orientation-neutral interventions to prevent or address
7171 unlawful conduct or unsafe sexual practices, if that counseling
7272 does not seek to change sexual orientation or gender identity; or
7373 (2) provides support to a child or minor undergoing
7474 gender transition in accordance with established standards of care.
7575 (c) A mental health provider who commits unprofessional
7676 conduct under Subsection (a) is subject to disciplinary action by
7777 any state regulatory entity with the power to take disciplinary
7878 action against that mental health provider.
7979 SECTION 5. This Act takes effect September 1, 2015.
